Ja. <br /> 01111111 <br /> ORDINANCE NO. 2360-99 <br /> AN ORDINANCE providing for the adoption of the 1997 Edition of the Uniform <br /> Fire Code and the Uniform Fire Code Standards, and repealing Ordinance No. <br /> 2075-95 (Chapter 16.03 EMC). <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public health, safety, <br /> and welfare; and <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by this ordinance <br /> would create a public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to implement and <br /> enforce the herein adopted code; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This Ordinance shall be known as the "Everett Fire Code." <br /> Section 2: There is hereby established in the City of Everett,the Fire Department which shall <br /> be under the jurisdiction of the Fire Chief, designated by the Mayor. <br /> Section 3: The Uniform Fire Code, Volume 1, (hereinafter referred to as The Uniform Fire <br /> Code or "UFC"), including Appendices I-A, I-B, I-C, II-A, II-B, II-C, II-E, II-F, II-G, II-H, II-I, <br /> II-J, III-A, III-B, III-C, III-D, IV-B, V-A, and the Uniform Fire Code Standards (hereinafter <br /> referred to as the Uniform Fire Code Standards or "UFCS"),published by the International Fire <br /> Code Institute, being particularly the 1997 Editions as amended by Chapters 51-44 and 51-45 <br /> WAC thereof and the whole thereof, save and except such portions as are hereinafter deleted, <br /> modified or amended are hereby adopted by reference and incorporated herein as fully as if set <br /> out at length herein. <br /> Section 4: Section 103.1.4 of the 1997 Edition of the UFC is hereby amended by deleting: <br /> To determine the suitability of alternate materials and types of construction and to <br /> provide for reasonable interpretations of the provisions of this code,there shall be and <br /> hereby is created a board of appeals consisting of five members who are qualified by <br /> experience and training to pass judgment upon pertinent matters. The chief shall be an ex <br /> officio member and shall act as secretary of the board. The board of appeals shall be <br /> appointed by the executive body and shall hold office at their pleasure. The board shall <br /> adopt reasonable rules and regulations for conducting its investigations and shall render <br /> decisions and findings in writing to the fire chief, with a duplicate copy to the appellant. <br />
