Ja. 01111111 ORDINANCE NO. 2360-99 AN ORDINANCE providing for the adoption of the 1997 Edition of the Uniform Fire Code and the Uniform Fire Code Standards, and repealing Ordinance No. 2075-95 (Chapter 16.03 EMC). WHEREAS, the City Council finds that this ordinance serves to protect the public health, safety, and welfare; and WHEREAS, the City Council finds that the absence of the regulations adopted by this ordinance would create a public harm and a public nuisance; and WHEREAS, the City Council finds that the City is mandated by the State to implement and enforce the herein adopted code; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: This Ordinance shall be known as the "Everett Fire Code." Section 2: There is hereby established in the City of Everett,the Fire Department which shall be under the jurisdiction of the Fire Chief, designated by the Mayor. Section 3: The Uniform Fire Code, Volume 1, (hereinafter referred to as The Uniform Fire Code or "UFC"), including Appendices I-A, I-B, I-C, II-A, II-B, II-C, II-E, II-F, II-G, II-H, II-I, II-J, III-A, III-B, III-C, III-D, IV-B, V-A, and the Uniform Fire Code Standards (hereinafter referred to as the Uniform Fire Code Standards or "UFCS"),published by the International Fire Code Institute, being particularly the 1997 Editions as amended by Chapters 51-44 and 51-45 WAC thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended are hereby adopted by reference and incorporated herein as fully as if set out at length herein. Section 4: Section 103.1.4 of the 1997 Edition of the UFC is hereby amended by deleting: To determine the suitability of alternate materials and types of construction and to provide for reasonable interpretations of the provisions of this code,there shall be and hereby is created a board of appeals consisting of five members who are qualified by experience and training to pass judgment upon pertinent matters. The chief shall be an ex officio member and shall act as secretary of the board. The board of appeals shall be appointed by the executive body and shall hold office at their pleasure. The board shall adopt reasonable rules and regulations for conducting its investigations and shall render decisions and findings in writing to the fire chief, with a duplicate copy to the appellant.
