. ,r <br /> Ty� <br /> ORDINANCE NO. 2458-00 <br /> AN ORDINANCE ADOPTING PROCEDURES FOR MAKING BIDS AND LETTING CONTRACTS AND <br /> AMENDING THE CITY'S COMPETITIVE BIDDING PROCEDURES, ORDINANCE No. 317-74 §1-3 <br /> AS AMENDED BY ORDINANCE No.'s 906-82 §1, 966-83 §1, 1500-88 §1, 1836-91 §1, 2183- <br /> 96 §1, 2263-97 §1 (CHAPTER 3.44 EMC) <br /> WHEREAS, Everett City Charter §4.13 provides that the Council may establish the <br /> procedures for making bids and letting contracts; and <br /> WHEREAS, attached hereto as Exhibit A are the PURCHASING AND SURPLUS <br /> PROPERTY GUIDELINES establishing the City's procedures for making bids and <br /> letting contracts; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Sections 1-3 of Ordinance No. 317-74 as amended by Section 1 of Ordinance <br /> No. 906-82, Section 1 Ordinance No. 966-83, Section 1 of Ordinance No. 1500-88, <br /> Section 1 of Ordinance No. 1836-91, Section 1 of Ordinance No. 2183-96 and Section 1 <br /> of Ordinance No. 2263-97 (Chapter 3.44 EMC)which read as follows: <br /> EMC 3.44.010 Public work defined. <br /> The term "work" or "public work" means all work, construction, alteration, repair or <br /> improvement, other than engineering analysis and design and other professional services, <br /> and ordinary maintenance, executed at the direction of the city. <br /> EMC 3.44.020 Lowest responsible bidder. <br /> Except as otherwise provided herein, purchases and contracts for public works shall be by <br /> competitive bidding and let to the lowest responsive and responsible bidder. In <br /> determining "lowest responsible bidder," in addition to price, the following elements shall <br /> be given consideration: <br /> A. The ability, capacity and skill of the bidder to perform the contract or provide the <br /> service required; <br /> B. The character, integrity, reputation,judgment, experience and efficiency of the <br /> bidder; <br /> C. Whether the bidder can perform the contract within the time specified; <br /> D. The quality of performance of previous contracts or services; <br /> E. The previous and existing compliance by the bidder with laws relating to the <br /> contract or services; <br />
