. ,r Ty� ORDINANCE NO. 2458-00 AN ORDINANCE ADOPTING PROCEDURES FOR MAKING BIDS AND LETTING CONTRACTS AND AMENDING THE CITY'S COMPETITIVE BIDDING PROCEDURES, ORDINANCE No. 317-74 §1-3 AS AMENDED BY ORDINANCE No.'s 906-82 §1, 966-83 §1, 1500-88 §1, 1836-91 §1, 2183- 96 §1, 2263-97 §1 (CHAPTER 3.44 EMC) WHEREAS, Everett City Charter §4.13 provides that the Council may establish the procedures for making bids and letting contracts; and WHEREAS, attached hereto as Exhibit A are the PURCHASING AND SURPLUS PROPERTY GUIDELINES establishing the City's procedures for making bids and letting contracts; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Sections 1-3 of Ordinance No. 317-74 as amended by Section 1 of Ordinance No. 906-82, Section 1 Ordinance No. 966-83, Section 1 of Ordinance No. 1500-88, Section 1 of Ordinance No. 1836-91, Section 1 of Ordinance No. 2183-96 and Section 1 of Ordinance No. 2263-97 (Chapter 3.44 EMC)which read as follows: EMC 3.44.010 Public work defined. The term "work" or "public work" means all work, construction, alteration, repair or improvement, other than engineering analysis and design and other professional services, and ordinary maintenance, executed at the direction of the city. EMC 3.44.020 Lowest responsible bidder. Except as otherwise provided herein, purchases and contracts for public works shall be by competitive bidding and let to the lowest responsive and responsible bidder. In determining "lowest responsible bidder," in addition to price, the following elements shall be given consideration: A. The ability, capacity and skill of the bidder to perform the contract or provide the service required; B. The character, integrity, reputation,judgment, experience and efficiency of the bidder; C. Whether the bidder can perform the contract within the time specified; D. The quality of performance of previous contracts or services; E. The previous and existing compliance by the bidder with laws relating to the contract or services;
