_ r <br /> ORDINANCE NO. \ \1.__T _ <br /> An ordinance requiring and directing the Great Northern <br /> Railway Company to change the elevation of the bridge maintained <br /> by it over its tracks at Oakes Avenue in the city of Averett, so as <br /> to conform to the present grade of Oakes Avenue, and declaring an <br /> emergency. <br /> WHLRAAS, the Great Northern Railway Company has constructed <br /> and is now maintaining a bridge on Oakes Avenue over its railway <br /> tracks, said bridge having been constructed and being maintained <br /> pursuant to Ordinance No. 234, and amendments thereto , of the city <br /> of Averett, and <br /> VHARAAS, by Ordinance No. 1228, and amendments thereto,of <br /> the city of Averett, the grade of Oakes Avenue was re-established and <br /> changed, and pursuant to said ordinance the necessary land was con- <br /> demned for the purpose of changing said grade, and <br /> `HAR AS, by Ordinance No. 1398 of the city of Everett, <br /> said grade of said Oakes Avenue has been actually changed so as to <br /> conform to said grade as re-established and changed, and <br /> WH 1R AS, the elevation of said bridge maintained by said <br /> Great northern Railway Company on Oakes Avenue does not conform to <br /> the grade of said street as re-established and changed, and by <br /> reason thereof said street is now dangerous and impassable, and <br /> WHEREAS, public convenience and necessity requires that <br /> the elevation of said bridge be changed so as to conform to the <br /> grade of said street as it now exists, <br /> NOW TRdRAFORA, TICS CITY OF r:VARJ TT DOHS ORDAIN: <br /> Section 1: That the Great Northern Railway Company be, <br /> and it is hereby required and directed, at its own cost, to change <br /> the elevation of the bridge now maintained by it on Oakes Avenue <br /> over its railway tracks so as to conform to the grade of Oakes <br /> Avenue as re-established and as it now exists. <br />
