1100111W <br /> ORDINANCE NO.2851-05 <br /> An Ordinance Rezoning the Legowick and Martinis properties <br /> from B-2 (Community Business) to R-1 (Single-Family Detached Low Density) <br /> located at 4325 and 4331 Terrace Drive. <br /> WHEREAS, the City of Everett adopted a new Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS,the Growth Management Act, codified as Chapter 36.70A, allows for <br /> comprehensive plans to be considered for amendment on an annual basis; and <br /> WHEREAS,the City of Everett initiated its 2004 annual comprehensive plan amendment <br /> process in July, 2004, which included consideration of Land Use Map amendments sponsored by <br /> the Planning Commission, including the properties described in this Ordinance; and <br /> WHEREAS,the City of Everett adopted Ordinance#1671-89 establishing a new Zoning Code <br /> which became effective January 13, 1990, and <br /> WHEREAS, Kim Legowik, owner of property located at 4325 Terrace Drive contacted the <br /> Planning Department regarding a split zone condition, with both B-2 (Community Business) <br /> and R-1 (Single Family Detached Low Density) on the same lot; and <br /> WHEREAS, in the course of investigation the Planning Department determined that in addition <br /> to the split zone condition both the Legowik property and the property located to the south, at <br /> 4331 Terrace Drive and owned by Dale Martinis, was zoned B-2 with an underlying <br /> Comprehensive Plan designation of Single Family(1.2), meaning the Comprehensive Plan <br /> designation and zone district were inconsistent with each other; and <br /> WHEREAS,the Growth Management Act requires the City's Zoning Map and Comprehensive <br /> Plan Land Use Map to be consistent; and <br /> WHEREAS,the Planning Commission determined that the split zone condition and the <br /> Comprehensive Plan/Zone District inconsistency needs to be resolved and therefore initiated <br /> consideration of a comprehensive plan amendment and rezone process to determine how to <br /> resolve the inconsistency; and <br /> WHEREAS,the Planning Commission held a decision public hearing on June 7, 2005, <br /> following previous public hearings on the matter on February 1, 2005 and May 24, 2005, during <br /> 1 <br />
