RESOLUTION NO. 5685 <br /> 7401/CETT <br /> A RESOLUTION Authorizing the Snohomish County PUD <br /> To File or Cause to be Filed on the City of Everett's behalf with the <br /> Federal Energy Regulatory Commission An Application for <br /> Non-Capacity Related License Amendment to Amend the <br /> Jackson Hydroelectric Project Recreation Plan <br /> WHEREAS, by Order issued December 5, 1994, the Federal Energy Regulatory <br /> Commission ("FERC") approved a Recreation Plan(the"Plan") for the Jackson <br /> Hydroelectric Project (the "Project"); and <br /> WHEREAS, such Plan included a number of improved recreation sites, including <br /> Recreation Site 6, at Culmback Dam. Such Site contains a restroom and viewpoint <br /> facilities only; and <br /> WHEREAS, following the events of September 11, 2001, the FERC Commission <br /> requested that all hydroelectric facility owners evaluate their needs for increased security, <br /> and in June, 2002, such Commission implemented a Hydro Security Program ("HSP") to <br /> require hydroelectric licensees to adopt specific measures to ensure adequate security at <br /> their facilities; and <br /> WHEREAS, to comply with the FERC's HSP, the District instituted certain security <br /> measures, including restriction of public access to the Project's Culmback Dam, which <br /> contains Recreation Site 6, and the District now believes that such security measures are <br /> likely to be in effect long-term; and <br /> WHEREAS, the FERC's HSP requires licensees to seek modifications to project <br /> recreation plans or other license requirements as a result of permanent security-related <br /> measures undertaken in response to the events of September 11, 2001, <br /> NOW, THEREFORE, BE IT RESOLVED by the Everett City Council as follows: <br /> 1. The Snohomish County PUD is hereby authorized to sign and file with FERC on <br /> the City of Everett's behalf a cover letter and an "Application for Amendment of <br /> License To Conform the Project Recreation Plan to Certain Security Measures," <br /> substantially in the form attached hereto as Exhibits A and B.
