d �f Ordinance No. 3439-15 *4tig;4 An Ordinance amending the Zoning Code to allow storage and maintenance facilities for public transportation agencies as a Special Property Use in the B-2 (Community Business) zone, amending Section 4 of Ordinance No. 1671-89 and Section 36 of Ordinance No. 2397-99, as amended (EMC Title 19, Zoning). WHEREAS, the City Council finds the following: 1. The Zoning Code is codified in Everett Municipal Code Title 19, regulating the use of land within various use zones within the City; and 2. The City received a request from the Washington State Department of Transportation (WSDOT) to amend the permitted uses in the B-2 (Community Business) zone to allow maintenance facilities for public transportation agencies through the Special Property Use permit process; and 3. The Planning Commission agreed to initiate consideration of the requested code amendment; and 4. City staff have reviewed the request and have recommended that the requested amendment be approved; and 5. The Planning Commission held a public workshop on March 10, 2015, and a public hearing on April 21, 2015, to consider the proposed amendment, and has recommended that the City Council approve the proposed amendment to the Zoning Code; and WHEREAS, the City Council concludes the following: 1. The proposed amendment is consistent with the Everett Growth Management Comprehensive Plan; and 2. The proposed amendment bears a substantial relation to the public health, safety and welfare; and 3. The proposed amendment promotes the best long term interests of the Everett community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 1
