OPb ,/•la- <br /> RESOLUTION NO. 5505 <br /> A RESOLUTION of the City Council of the City of Everett relating to <br /> community renewal; authorizing the Housing Authority of the City of Everett to <br /> serve as a community renewal agency, to prepare a community renewal plan, and <br /> to exercise the powers of a community renewal agency. <br /> WHEREAS, on July 21, 2004, the City Council adopted Resolution No. 5504 , <br /> under which the City Council made a finding pursuant to the state Community Renewal Law <br /> (RCW 35.81) that: (a) the Residential Area next to the Former Asarco Smelter, in its present <br /> condition, is a"blighted area" under RCW 35.81.050; and(b) the rehabilitation, redevelopment, <br /> of a combination thereof, of such area is necessary in the interest of the public health, safety, <br /> morals, or welfare of the residents of the City of Everett; and <br /> WHEREAS, the recitals, facts, findings, and map of the Residential Area next to the <br /> Former Asarco Smelter Site, contained in Resolution No. 5504 , are incorporated by <br /> reference herein; and <br /> WHEREAS,under the state Community Renewal Law, after adoption of an ordinance or <br /> resolution making the findings described above, a municipality may by ordinance or resolution <br /> elect to have the powers of a community renewal agency exercised by a housing authority <br /> created under RCW 35.82; and <br /> WHEREAS,the Housing Authority of the City of Everett("Everett Housing Authority") <br /> is a housing authority created under RCW 35.82; and <br /> WHEREAS,the Everett Housing Authority desires to rehabilitate, sell, and/or redevelop <br /> certain properties in the Residential Area next to the Former Asarco Smelter; and <br /> WHEREAS, the Everett Housing Authority is entering into agreements with the City of <br /> Everett, Washington State Department of Ecology ("Ecology"), Asarco Incorporated("Asarco"), <br /> and other entities to take certain responsibility for the cleanup and rehabilitation of the <br /> Residential Area next to the Former Asarco Smelter; and <br /> WHEREAS, under said agreements, the Everett Housing Authority will remediate any <br /> property it may acquire from Asarco within the blighted area designated under Resolution <br /> No. 5504 to residential cleanup levels determined by Ecology to be suitable for single <br /> family residential use; and <br /> Page 1 of 3 <br />
