AIIP <br /> a -ETT <br /> 4iiiiiORDINANCE NO. 2210-97 <br /> AN ORDINANCE amending the moratorium on public places of adult entertainment and <br /> adult use businesses, Ordinance No. 2138-96, as amended, by extending the <br /> moratorium for a second six month renewal period <br /> WHEREAS,the City Council does find: <br /> 1. Since the adoption of the moratorium on public places of adult entertainment <br /> and adult use businesses, Ordinance No. 2138-96, the City's interim zoning <br /> amendments (Ordinance No. 2144-96) and interim comprehensive plan <br /> amendments (Ordinance No. 2143-96) together with their amendments have <br /> been challenged before the Growth Hearings Board. Additionally, challenges to <br /> the City's adult use policy and regulatory strategy are pending in both state <br /> court and federal court; and . <br /> 2. Said interim zoning regulations and comprehensive plan policies were intended <br /> to protect and provide safety to certain sensitive land uses from the secondary <br /> adverse impacts of adult use businesses; and <br /> 3. On February 19, 1997, the City Council held a public hearing and amended and <br /> finalized the interim emergency measures of the comprehensive plan policies and <br /> zoning regulations related to adult use businesses making them permanent <br /> through the adoption of Ordinance No's. 2203-97 and 2204-97; and <br /> 4. The City receives business inquiries concerning existing regulations relating to <br /> sexually oriented adult entertainment businesses and various licensing and permit <br /> applications relating to such businesses; and <br /> 5. Absent the existence of such adult use zoning regulations and comprehensive <br /> plan policies, the City cannot regulate these businesses and the secondary <br /> adverse impacts of these businesses through the use of separation requirements; <br /> and <br /> 6. These secondary adverse impacts pose a threat to the public health and safety; <br /> and <br /> 7. Until the City satisfactorily resolves the litigation concerning its comprehensive <br /> plan and zoning code related to adult use businesses, the City's policy and <br /> regulatory strategy is in jeopardy of being compromised absent the existence of <br /> this moratorium; and. <br /> 1 <br />
