ORDINANCE NO. 2136-96 <br /> AN ORDINANCE establishing interim administrative procedures for the processing o <br /> project permit applications as required by the Regulatory Reform Act and declaring an <br /> emergency to exist. <br /> Whereas, the Regulatory Reform Act (chapter 347 of the 1995 Laws of Washington) <br /> requires that the City establish a permit review process which, among other things: (1) <br /> provides for the integrated and consolidated review and decision on two or more project <br /> permits relating to a proposed action; (2) combines the environmental review process, <br /> both procedural and substantive, with the procedure for the review of project permits; (3) <br /> provides for not more than one open record hearing and one closed record appeal on such <br /> permits, except for the appeal of a determination of significance; and (4) except in the case <br /> of an appeal, provides for the issuance of the City's final decision within 120 calendar days <br /> after submission of a complete application; and <br /> Whereas, the Act is structured to rely on the comprehensive plan as the City's vision to <br /> guide development. The City's role in the project permit review process is essentially to <br /> determine consistency and compliance with the comprehensive plan and the City's <br /> implementing regulations; and <br /> Whereas,the Act is also intended to provide predictability by limiting the amount of time <br /> permitted to process applications, to hear appeals and to provide greater structure to the <br /> permit review process; and <br /> Whereas, the Act requires that the City adopt such permit review process by March 31, <br /> 1996, and that it shall apply to project permit applications filed on or after April 1, 1996. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: PURPOSE <br /> The purpose of this ordinance is to implement certain state requirements contained in <br /> Chapter 347, Laws of 1995, the Regulatory Reform Act ("Act"), relating to the <br /> integration of growth management planning and environmental review. The provisions <br /> contained within this ordinance constitute interim regulations. <br /> A. Actions Exempt from Procedural Requirements <br /> The project permit procedural requirements of this ordinance pertaining to notice of <br /> completeness, notice of application, and notice of decision shall not apply to Review <br /> Process I or Review Process V decisions. Specifically exempted from these procedural <br /> requirements and the requirements of the Act, sections 407 through 417 are: <br />
