ii4P-: .2 '''' svelignillA Ordinance No. 2132-96 An ordinance amending Ordinance No. 790-81 to allow the construction of a thirteen(13)unit apartment building for the property generally described as 103 Dorn Avenue,the corner of Holly and Dorn. WHEREAS, Ordinance No. 790-81 amended the Zoning Map rezoning the following area from R-3 to C-1 with concomitant agreement: Lot 1 &2 Replat of Lot 15, Beverly Garden Tract No. 1 in Section 13 T.28 R.4 NWM; and WHEREAS,the owner of the above-described property has requested an amendment to the concomitant agreement permitting the development of a thirteen unit apartment building on the property rather than the professional office use approved per Ordinance no. 790-81; and WHEREAS,the Hearing examiner has approved the request and recommends to City Council the approval of the amendment to the concomitant agreement; NOW, THEREFORE,the City of Everett does ordain: Section 1: Ordinance No. 790-81 adopted a concomitant agreement for the rezone which was attached thereto. Ordinance No. 790-81 is hereby amended by the adoption of"Exhibit 1", an addendum to the concomitant agreement, which is attached hereto and incorporated herein by reference. Section 2: The City Clerk is hereby instructed to file a duly certified copy of this ordinance with the County Auditor of Snohomish County,Washington. Section 3: This ordinance shall become effective fifteen days after the date it becomes valid unless the property owner does not execute the addendum to the concomitant agreement set forth in"Exhibit 1" and submit it to the City no later than fifteen days after the date the ordinance becomes valid.
