• <br /> 4,44::ad <br /> ORDINANCE NO. 2111.-95 <br /> AN ORDINANCE addressing the siting of jails and <br /> correctional facilities including Class II Group-Care Homes, <br /> amending the Zoning Code, Ordinance No. 1671-89 (Title 19 EMC) as <br /> amended by Ordinance No' s . 1811-91, 1848-92, 1864-92 and 1958-93 <br /> Whereas, RCW 36.70A.200 (1) and WAC 365-195-340 (1) (a) define <br /> "essential public facilities" as those facilities that are <br /> typically difficult to site, such as airports, state education <br /> facilities, state and local correctional facilities, state or <br /> regional transportation facilities, solid waste handling <br /> facilities, and in-patient facilities including substance abuse <br /> facilities, mental health facilities, and group homes; and <br /> Whereas, RCW 36.70A.200 (2) provides that no local comprehensive <br /> plan or development regulation may preclude the siting of <br /> essential public facilities; and <br /> Whereas, WAC 365-195-340 (2) recognizes the regional impact and <br /> responsibility associated with the siting of certain essential <br /> public facilities by recommending that agreements among <br /> jurisdictions should be sought to mitigate any disproportionate <br /> financial burden which may fall on the jurisdiction which becomes <br /> the site of a facility of a state-wide, regional, or county-wide <br /> nature; and <br /> Whereas, the City' s comprehensive plan, which has been approved <br /> by the State, provides a number of policies concerning the need <br /> to disperse through out Snohomish County the siting of essential <br /> public facilities that serve a County, regional or State-wide <br /> need including: <br /> 1 . 7 . . .The Snohomish County-wide Planning Policies, in addition to <br /> addressing the land use impacts of public capital facilities, <br /> call for developing a common site review process to site capital <br /> facilities of a County-wide or State-wide nature to ensure that <br /> local comprehensive plans do not preclude the establishment of <br /> public capital facilities necessary to support urban development. <br /> This policy intends, in part, to ensure that a "fair share" <br /> distribution of the impacts from siting essential public <br /> facilities occurs, and that no community within the county has a <br /> disproportionate share of public facilities, such as jails, solid <br /> waste transfer stations, and other facilities which create <br /> undesirable impacts . . . <br />
