ORDINANCE NO. 2103-95 AN ORDINANCE relating to curfew regulations for minors, expanding the juvenile curfew to apply city-wide and making the city's curfew regulations permanent, amending sections 1 and 2 of Ordinance No. 2001-94 (EMC 9.80.010 and .020), repealing section 3 of Ordinance No. 2001-94 (EMC 9.80.030), and amending section 11 of Ordinance No. 2001-94. WHEREAS, the City has had a positive experience with the application of the juvenile curfew in the Central Business District, and WHEREAS, late at night, minors in public places throughout the City of Everett are particularly vulnerable to being victimized and abused, and WHEREAS, the City of Everett believes that parental responsibility and supervision must continue to be encouraged and promoted; and WHEREAS, members of various neighborhood groups have requested the City's downtown curfew be extended to apply city-wide; and WHEREAS, the City Council has heard testimony from the Everett Police Department, and from members of the public concerning the need to continue to have effective tools to protect minors from the dangers and temptations that exist in public places late at night; and WHEREAS, Ordinance No. 2001-94, adopted on April 27, 1994, and originally set to expire on October 31, 1994, was extended to be effective through October 31, 1995 by Resolution No. 4013; and WHEREAS, the City Council finds that a city-wide juvenile curfew and parental responsibility ordinance will preserve the public safety and reduce acts of violence by and against juveniles that are occumng at rates beyond the capacity of the police to assure public safety; and WHEREAS, the City Council finds that reasonable regulations on the hours which minors under the age of eighteen may be in or upon public streets, parks or other public places throughout the City will protect the minors of this municipality, and reinforce parental responsibility and authority; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: Section 1 of Ordinance No. 2001-94 (EMC 9.80.010), which reads as follows:
