1L RETT <br /> ORDINANCE NO. 2086-95 <br /> AN ORDINANCE of the City of Everett, Washington, relating to municipal <br /> finance and excises for revenue; establishing and imposing excises on solid waste <br /> handling facilities in the City of Everett. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: RECITALS AND FINDINGS <br /> 1.1 The City of Everett ("City") is a city of the first class, with authority to grant <br /> licenses for any lawful purpose and to impose excises for revenue. Chapter 35.22 RCW and <br /> RCW 35A.82.020. <br /> 1.2 The City hosts public and private facilities that provide services and programs to <br /> residents of Everett and to residents of Snohomish County, Snohomish County cities and other <br /> counties. Such facilities that are used by or are of benefit to people within and without Everett <br /> include City parks, and the solid waste handling facilities discussed herein. <br /> 1.3 The City manages certain solid waste handling functions, including planning, waste <br /> reduction and recycling programs. In addition to City activities, private operators and Snohomish <br /> County ("County") perform solid waste handling functions within the City. Such functions and <br /> activities create demands on the general fund of the City, including but not limited to costs <br /> associated with maintaining roads for transportation vehicles that haul solid waste to County <br /> transfer stations and to private solid waste facilities within the City. <br /> 1.4 The City provides an environment of services and protection that enables both <br /> public entities and private solid waste handling businesses and operators, including transfer <br /> stations and intermodal facilities, to engage in solid waste handling activities in the City. That <br /> environment of services and protection includes but is not limited to police protection, fire <br /> protection, litter control, the availability of utility services, and streets and housing. <br /> 1.5 Under the Contract Regarding Solid Waste Transport and Disposal for Snohomish <br /> County, Washington ("Contract"), the County was provided two prices, one with and one <br /> without the City's waste stream. The inclusion of the City's solid waste with County-wide solid <br /> waste benefits the County's solid waste system by over $3.40 per ton. <br /> 1.6 Under the Contact, the contractor receives a fee of$19.75 (as adjusted from time to <br /> time in accordance with the Contract) per ton of solid waste hauled, as the transportation <br /> component of the contractor's tipping fee. <br /> 1 <br />
