ORDINANCE No. x,0419—q5 <br /> An Ordinance establishing a Binding Site Plan process for land zoned for business, <br /> commercial, industrial, and residential condominium on land zoned for such purposes, <br /> and superseding Ordinance No. 1120-85 (Chapter 18.44 EMC). <br /> WHEREAS, Section 58.17.035 RCW authorizes local governments to adopt <br /> Ordinances that authorize divisions of land to be developed for business, commercial, <br /> industrial and residential condominium pursuant to Chapter 64.32 or 64.34 RCW by <br /> the use of a Binding Site Plan as an alternative to the subdivision procedures <br /> established by Chapter 58.17 RCW; and <br /> WHEREAS, the City of Everett by Ordinance No. 1120-85 authorizes the use of <br /> a Binding Site Plan only for the division of business, commercial, and industrial zoned <br /> land within the City of Everett; and <br /> WHEREAS, the City Council finds that there exists a need to revise the City's <br /> Binding Site Plan Ordinance to include an option for allowing residential condominium <br /> to be divided and developed under one procedure similar to business, commercial, and <br /> industrial zoned areas; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION I: ADMINISTRATION <br /> A. Title <br /> B. Authority <br /> C. Purpose <br /> D. Jurisdiction <br /> E. Applicability <br /> F. Administration <br /> G. Definitions <br /> A. Title <br /> This Ordinance shall be known as the "Binding Site Plan Ordinance of the City." <br /> The requirements set forth in this Ordinance are applicable to all divisions of <br /> land zoned business, commercial, and industrial and for residential <br /> condominiums located on land zoned for residential uses within the City. <br /> B. Authority <br /> These regulations are authorized by Chapter 58.17 RCW and all other <br /> applicable state laws and City Ordinances. <br /> 3 <br />
