sP <br /> „wiEL/ERETT <br /> ORDINANCE NO. 2012-94 <br /> An Ordinance amending the City's Zoning Code concerning notification requirements for <br /> area-wide rezones and City Council's consideration of Planning Commission recommendations, <br /> amending Section 41.160 of Ordinance No. 1671-89 (EMC 19.41.160), and Section 42.130 of <br /> Ordinance No. 1671-89 (EMC 19.42.130), as amended by Ordinance No. 1788-91 <br /> WHEREAS, the City adopted Ordinance No. 1671-89 establishing a new Zoning Code for the <br /> City on December 28, 1989; and <br /> WHEREAS, Section 41.160.B.3 of Ordinance No. 1671-89 sets forth the procedures to be used <br /> for notification for both "site-specific rezones" and "area-wide rezones," which are identical and <br /> require the notification of all owners of property within 500 feet of the boundaries of all <br /> properties proposed to be rezoned; and <br /> WHEREAS, the State Legislature adopted the Growth Management Act in 1990 which mandated <br /> the adoption of new Comprehensive Plans by cities and counties in Washington, and that these <br /> plans accomplish many different objectives related to land use, such as the reduction of urban <br /> sprawl, the protection of natural resource lands, increased housing densities in urban areas, <br /> sufficient land for future economic growth, and protection of"critical areas;" and <br /> WHEREAS, the Growth Management Act requires that zoning maps be consistent with the Land <br /> Use Map of the Comprehensive Plan adopted pursuant to the Act; and <br /> WHEREAS, the Growth Management Act requires "early and continuous public involvement" in <br /> the Comprehensive Plan development process; and <br /> WHEREAS, the City of Everett has conducted an extensive public outreach and participation <br /> process in developing its Growth Management Comprehensive Plan; and <br /> WHEREAS, this extensive public participation process is unique to the development of the <br /> Growth Management Comprehensive Plan and does not occur for less comprehensive area-wide <br /> rezones; and <br /> WHEREAS, the Preferred Alternative for the Comprehensive Plan will require the rezoning of <br /> numerous parts of the City to implement the land use map; and <br /> WHEREAS, in establishing the notification requirements of Section 41.160.B.3 of Ordinance No. <br /> 1671-89, the City did not anticipate the requirements for city-wide revisions to the Zoning Map <br /> dictated by the Growth Management Act; and <br />
