• <br /> �ry <br /> RESOLUTION NO. 4351 <br /> A Resolution Amending Resolution No. 3592, Granting an Extension, Modification and <br /> Variance to the Resolution of Intent to Rezone for Property Located South of SR 526, <br /> North of Casino Road, East of Hardeson Road and West of Upper Ridge Road <br /> in the City of Everett (Casino Ridge Apartments) <br /> WHEREAS, ROYAL FLUSH PARTNERSHIP represented by Marianne Christian-Griffith, <br /> filed an application to rezone property located south of SR 526, north of Casino Road, east <br /> of Hardeson Road and west of Upper Ridge Road from R-3 PRD (Multi-Family Medium <br /> Density Planned Residential Development) to R-3 (Multi-Family Medium Density Residential) <br /> for the purpose of developing a 36 unit apartment complex; and <br /> WHEREAS, a Resolution of Intent to Rezone was approved by City Council on January 29, <br /> 1992 and the approval expires on January 29, 1997, Resolution No. 3592; and <br /> WHEREAS, Homestead Alternatives, on behalf of Royal Flush Partnership, submitted an <br /> application for a 5 year extension of the Resolution of Intent to Rezone, with a proposed <br /> revision to allow the zoning to revert to R-3, rather than R-3 PRD if the Intent to Rezone <br /> expires, and applications for a wetland buffer width reduction and a height variance; and <br /> WHEREAS, the Hearing Examiner held a public hearing and did adopt findings, conclusions <br /> and decision dated October 17, 1996, recommending to the Everett City Council that the <br /> proposed extension of the Resolution of Intent to Rezone be approved pursuant to the <br /> provisions of Section 41.160 D. 3(b) of Ordinance No. 1671-89, as amended, subject to the <br /> conditions of the decision, and that the proposed wetland buffer width reduction and height <br /> variance be approved in accordance with the conditions of the Examiner's decision; and <br /> WHEREAS, the City Council Finds: <br /> 1. The rezone is consistent with the Everett General Plan; and <br /> 2. The rezone bears a substantial relation to the public health, safety and <br /> welfare and promotes the best long term interest of the Everett community; <br /> and <br /> 3. The terms of this Resolution are sufficient to mitigate adverse impacts upon <br /> existing or anticipated land uses in the immediate vicinity of the property <br /> herein described; <br /> NOW, THEREFORE, Be it Resolved by the City Council of the City of Everett that: <br /> Section 1: It does hereby adopt the Hearing Examiner's Findings, Conclusions and <br /> Decision dated October 17, 1996, hereinafter referred to as "Decision" which is attached <br /> hereto and incorporated herein by reference as Exhibit "A". <br />
