r <br /> 140/0,00.4 <br /> RESOLUTION NO. 4227 <br /> A RESOLUTION pursuant to the Uniform Code for the Abatement of <br /> Dangerous Buildings and the Uniform Housing Code, declaring an emergency <br /> to exist, and authorizing the demolition and clearing of the buildings from the <br /> property situated at 8830 Evergreen Way, Everett, WA. <br /> WHEREAS, the City Council finds that the buildings which are located at 8830 Evergreen <br /> Way contain the following deficiencies which constitute an emergency for abatement pursuant <br /> to the Uniform Code for the Abatement of Dangerous Buildings and the Uniform Housing <br /> Code: <br /> Retail Store: <br /> Violations noted pursuant to the Uniform Code for the Abatement of Dangerous <br /> Buildings. <br /> 1. Vandalism has caused serious damage to the walls and other structural members <br /> of the building including broken doors, windows, and destruction of all vital <br /> systems, electrical, plumbing, and heating. <br /> 2. According to EPD, the building is used by gangs, minor children who find the <br /> building attractive, and is a harbor for run away minors. <br /> 3. According to EPD, there is the use of drugs on the premises. <br /> 4. EPD frequents the building each night upon receiving complaints, and with <br /> several vehicles at a time. <br /> 5. The building is a nuisance and endangers the health, safety, and welfare of the <br /> public, inquisitive minors in the area and adjoining properties. <br /> 6. The building is maintained in violation of requirements applicable to such <br /> buildings as provided by the building regulations of this jurisdiction, as <br /> specified in the Building Code. <br /> 7. The building is unsafe for dwelling purposes. <br /> 8. The building is in such a condition as to constitute a public nuisance known to <br /> the common law or in equity jurisprudence. <br /> 1 <br />
