001111p. EL IJFETT ORDINANCE NO. 1961-93 AN ORDINANCE providing for the vacation of a portion of a portion of 16th Avenue S.E. WHEREAS, the City Council of the City of Everett, did by Resolution No. 3822, duly adopt and fix the 8th day of September, 1993, at 8:30 a.m., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, the City Council finds it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: THAT PORTION OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 19, TOWNSHIP 28 NORTH, RANGE 5 EAST, W.M., DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID SUBDIVISION; THENCE S 89° 16' 53" E, ALONG THE SOUTH LINE OF SAID SUBDIVISION, A DISTANCE OF 30.02 FEET TO THE TRUE POINT OF BEGINNING; THENCE N 1° 14' 15" W, ALONG THE EASTERLY MARGIN OF 16TH AVENUE S.E., A DISTANCE OF 1.77 FEET TO THE POINT OF CURVATURE OF A CURVE TO THE RIGHT, HAVING A RADIUS OF 40.00 FEET; THENCE NORTHEASTERLY, ALONG THE ARC OF SAID CURVE TO THE RIGHT AND CONSUMING A CENTRAL ANGLE OF 42° 56' 49", AN ARC DISTANCE OF 29.98 FEET TO THE POINT OF REVERSE CURVATURE; THENCE NORTHERLY, ALONG THE ARC OF A CURVE TO THE LEFT, HAVING A RADIUS OF 55.00 FEET, AND CONSUMING A CENTRAL ANGLE OF 110° 14' 04", AN ARC DISTANCE OF 105.82 FEET; THENCE S 5° 17' 19" E, A DISTANCE OF 117.52 FEET TO THE TRUE POINT OF BEGINNING. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
