AV—A <br /> EL/EJdETT <br /> ORDINANCE NO. 1946-93 <br /> AN ORDINANCE extending the interim zoning regulations <br /> for adult bookstores, adult retail stores and <br /> adult video stores, and amending Section 2 of <br /> Ordinance No. 1860-92 as amended by Ordinance No. <br /> 1911-92 . <br /> WHEREAS, the City Council adopted Ordinance No. 1860-92 <br /> establishing interim zoning regulations for adult bookstores, <br /> adult retail stores and adult video stores providing the City an <br /> opportunity to review its adult use business regulations relative <br /> to these businesses; and <br /> WHEREAS, Ordinance No. 1860-92 would have expired on December 31, <br /> 1992 , absent an extension; and <br /> WHEREAS, following a public hearing, Ordinance No. 1911-92 was <br /> adopted extending Ordinance No. 1860-92 for an additional six (6) <br /> months; and <br /> WHEREAS, Ordinance No. 1860-92 needs to be further extended in <br /> accordance with the provisions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: The City Council makes the following findings of <br /> fact: <br /> A. World Wide Video v. Tukwila, 117 Wn. 2d 382 (1991) found that <br /> Tukwila improperly regulated adult use businesses with <br /> predominantly take-home merchandise; <br /> B. Ordinance No. 1860-92 established interim zoning regulations <br /> for adult bookstores, adult retail stores and adult video <br /> stores to provide the City an opportunity to evaluate their <br /> secondary adverse impacts; <br /> C. The City' s Police Department and Department of Planning and <br /> Community Development have developed a work plan to make <br /> this evaluation which is not complete as of this time; <br /> D. Through the adoption of Ordinance No. 1911-92 , the City <br /> previously extended Ordinance No. 1960-92 through June 30, <br /> 1992 . The City Council held a public hearing to consider <br /> the further extension of the interim regulations set forth <br /> in Ordinance No. 1860-92 ; and <br />
