. a <br /> RESOLUTION NO. 3;;F4/ <br /> A RESOLUTION adopting Findings and Conclusions <br /> granting Merrill Creek JV <br /> contract rezone request, No. 3-88 <br /> WHEREAS, the City Council finds that an application was <br /> received by the City of Everett by Mr. Don Huber of United <br /> Western Development, 1612 South Mildred Street, Suite A, <br /> Tacoma, WA 98465, requesting a rezone on a parcel of property <br /> approximately 94 . 5 acres in size from R-S, Single Family <br /> Suburban Residential and R-1 , Single Family Low Density <br /> Residence Zone to R-3(A) with concomitant agreement and <br /> approval of a phased master development site plan on a site <br /> located west of Glenwood Avenue, north of Merrill Creek <br /> Parkway, and south of Dover Street and Harbor Lane; and <br /> WHEREAS, the City Council finds that after due notice, <br /> public hearings were held before the City's Planning <br /> Commission on June 20 , 1989; July 18 , 1989; and October 17 , <br /> 1989, which resulted in a Planning Commission recommendation <br /> of approval of the rezone with a concomitant agreement to <br /> allow the construction of a 1 ,070 unit proposal ; and <br /> WHEREAS, the City Council finds that after due notice, <br /> public hearings were held on January 17 , 1990 and January 20, <br /> 1990 to consider testimony from the staff, the proponent, <br /> opponents and interested citizens; and <br /> WHEREAS, the City Council considered the testimony of all <br /> parties commenting on this proposal , all information provided <br /> by the Planning Commission, including the Environmental Impact <br /> Statement, and the exhibits presented at the hearings; <br />
