f RESOLUTION NO. 3,/,6‘ ?/,6‘ A Resolution denying the Appeal of the Hearing Examiner decision approving Subdivision Alteration #1-88 and Variance to establish and record an additional lot in the Plat of Kenilworth Hills No. 1 WHEREAS, on April 12, 1988, the City of Everett received an application from Pope Resources for a Subdivision Alteration and Variance to establish and record a 13,038 square foot parcel as a single family lot, the subject parcel being located in the 5700 block of Sound Avenue; and WHEREAS, on July 28, 1988 and August 18, 1988, the City of Everett Land Use Hearing Examiner did hold a public hearing on the proposed Subdivision Alteration and Variance and did on August 31, 1988, issue a decision approving said Subdivision Alteration to the plat of Kenilworth Hills No. 1 and a Variance to allow a lot depth of 65 feet rather than the standard depth of 80 feet; and WHEREAS, on September 13, 1988, a request for reconsideration of the Hearing Examiner's decision was submitted by Marc Y. J. Bhend and on October 11, 1988, the Hearing Examiner did issue an order denying the Request for Reconsideration; and WHEREAS, on October 19, 1988, the City Clerk did receive an appeal to City Council on this matter from Marc Y. J. Bhend; and WHEREAS, on March 2, 1989, the Hearing Examiner did make available to the City Council all exhibits submitted to his office by all parties of record, and copies of tapes of the public hearing held on July 28, 1988, and August 18, 1988; and WHEREAS, on March 8, 1989, upon due notification to all of the parties of record, and at a regular meeting of the Everett City Council and having reviewed the record herein, the City Council did consider the Appeal of the Hearing Examine-'s decision on Subdivision Alteration #1-88 of Marc Y. J. Bhend. NOW, the Everett City Council makes the following findings: 1. The City of Everett Land Use Hearing Examiner did conduct a legal public hearing in the matter of Subdivision Alteration #1-88 and Variance on July 28 and August 18, 1988.
