• 4 . ... <br /> • <br /> 1 ORDINANCE NO. 1724-90 <br /> 2 <br /> 3 AN ORDINANCE providing for the transfer of vacation leave between <br /> employees and establishing the conditions therefor, <br /> 4 providing that this ordinance is a pilot program with a one <br /> year sunset provision, establishing an emergency clause and <br /> 5 fixing a time when the same shall become effective. <br /> 6 <br /> 7 WHEREAS, the City provides vacation leave to its employees as a vested <br /> 8 right subject to payment upon termination; and <br /> 9 WHEREAS, the City Council finds it appropriate and in the public <br /> 10 interest to permit employees to share vacation leave in carefully defined <br /> 11 circumstances and to transfer such leave to and for the benefit of employees <br /> 12 who, without such transfers, would be forced to terminate their employment <br /> 13 or go without pay in order to meet the needs of severe illness; and <br /> 14 WHEREAS, the City Council finds that an emergency exists necessitating <br /> 15 the immediate institution of a pilot program to prevent an unnecessary <br /> 16 hardship on its employees; <br /> 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 18 Section 1 : SHARED LEAVE. <br /> 19 A. Intent. The purpose of shared leave is to permit City employees, <br /> 20 at no additional cost to any City fund other than the administrative costs <br /> 21 of administrating the program, to come to the aid of a fellow City employee <br /> 22 who is suffering from or has an immediate family member suffering from an <br /> 23 extraordinary or severe illness, injury, impairment, or physical or mental <br /> 24 conditions which has caused or is likely to cause the employee to take leave <br /> 25 without pay or to terminate his or her employment. <br /> 26 B. A Department Head, with the Mayor or designee's concurrence, may <br /> 27 approve a donee employee to receive shared leave under this ordinance if: <br /> 28 <br /> 1 . The employee suffers, or has an immediate family <br /> 29 member suffering from, an illness, injury, impairment, or <br /> physical or mental condition which is of an extraordinary or <br /> 30 severe nature and which has caused, or is likely to cause, the <br /> employee to go on leave without pay status or to terminate his or <br /> 31 her employment with the City. <br /> 32 <br />
