u=� <br /> CITY OF EVERETT lit . <br /> ORDINANCE NO. 2973-07 <br /> An Ordinance Amending Zoning Code Regulations for Accessory <br /> Buildings; Amending Section 4 of Ordinance No. 1671-89, as amended <br /> (EMC 19.04), Section 37 of Ordinance No. 2397-99 (EMC 19.06) as <br /> amended, Section 10 of Ordinance No. 2146-96 (EMC 19.07.020) as <br /> amended, Section 39.150 of Ordinance No. 1671-89 (EMC 19.39.150.C.2, <br /> EMC 19.39.150.C.5, EMC 19.39.150.C.12 AND EMC 19.39.150.D.2) as <br /> amended, Repealing Section 16 of Ordinance No. 2307-98 (EMC <br /> 19.15.120), and Amending the Local Project Review Procedures, <br /> Ordinance No. 2530-01, as amended (EMC 15.16.050 and EMC 15.16.080). <br /> WHEREAS, the Everett Zoning Code (EMC Title 19) contains regulations governing the <br /> location, size and design of residential accessory buildings; and <br /> WHEREAS, the Planning Commission initiated a review of the City's zoning regulations <br /> for residential accessory buildings; and <br /> WHEREAS, the proposed amendments were reviewed under the State Environmental <br /> Policy Act and a Determination of Nonsignificance was issued; and <br /> WHEREAS, the Planning Commission conducted three public hearings to review the <br /> proposed amendments and to take public testimony and recommended that the City <br /> Council approve the proposed amendments; and <br /> WHEREAS, the City Council finds that the proposed amendments are consistent with the <br /> criteria for amending the Zoning Code text as follows: <br /> 1. The proposed amendments are consistent with the applicable provisions of the <br /> Everett Comprehensive Plan. <br /> 2. The proposed amendments bear a substantial relation to public health, safety <br /> or welfare; and <br /> 3. The proposed amendments promote the best long term interests of the Everett <br /> community. <br /> NOW, THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Definition. Section 4of Ordinance No. 1671-89, as amended, (EMC <br /> 19.4.020) is amended by the addition of the following definition: <br />
