RESOLUTION NO. 7180 //4% ::= <br /> A Resolution Approving the First Amendment to the <br /> 74," <br /> Development Agreement Between the City of Everett and Snohomish County for <br /> an Addition to the Existing County Courthouse. <br /> WHEREAS, in 2002 the Everett City Council adopted Resolution No. 5248 establishing a <br /> Planned Development Overlay (PDO) zone for the Snohomish County Campus property <br /> bounded by Pacific Avenue on the south, Wetmore Avenue on the west, Wall Street on the north, <br /> and Lombard Avenue on the east, for the purpose of establishing a master plan for the <br /> redevelopment of the county campus; and <br /> WHEREAS,the City and the County entered into a Development Agreement as a means of <br /> implementing the master plan with conditions and requirements governing the redevelopment of <br /> the county campus; and <br /> WHEREAS, Snohomish County has completed the projects identified in the 2002 master plan <br /> and Development Agreement; and <br /> WHEREAS, Snohomish County has identified the need to make improvements to the existing <br /> County Courthouse building to improve the safety and functionality of the building, which <br /> necessitates construction of an addition to the building to the north of the existing courthouse <br /> comprising approximately 30,000 square feet of total building space with a footprint <br /> approximately 6,000 square feet; and <br /> WHEREAS,the proposed addition will require an amendment to the campus master plan that is <br /> the subject of the 2002 Resolution Rezoning the County Campus which authorized the Mayor to <br /> execute a Development Agreement between the City and County; and <br /> WHEREAS, the Courthouse addition will be constructed on a portion of the Snohomish County <br /> campus that is comprised of a public plaza and will reduce the amount of public open space on <br /> the campus; and <br /> WHEREAS,under the City's Planned Development Overlay zone regulations, any change to a <br /> master plan that reduces the amount of public open space is considered a major amendment that <br /> is subject to review by the Planning Commission and City Council; and <br /> WHEREAS,the Planning Commission held a Public Workshop on August 15, 2017, and held a <br /> Public Hearing on October 3, 2017, to consider public testimony concerning the proposed <br /> amendment to the PDO master plan; and <br /> WHEREAS, the Planning Commission has recommended that the City Council approve the <br /> proposed amendment to the PDO master plan to allow the addition to the Snohomish County <br /> Courthouse; and <br />
