w l ORDINANCE NO./6 6/-(? 2 AN ORDINANCE establishing minimum maintenance requirements for 3 property and repealing Ordinance No. ' s 1720 and 4058. 4 WHEREAS, the City Council finds that the City of Everett has statutory 5 authority to define and abate nuisances pursuant to RCW 35.22.280(30) ; and 6 WHEREAS, the City Council finds that the failure to provide minimum 7 maintenance of private property in the City of Everett constitutes a 8 nuisance; 9 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 10 Section 1 : DEFINITIONS. For the purpose of this ordinance, the 11 following definitions shall apply: 12 A. REAR YARD. "Rear yard" shall mean that portion of property 13 between the primary building and the rear property line. 14 B. BUILDING. "Building" shall mean any roofed and walled structure 15 for residential or non-residential use. 16 C. CITY. "City" shall mean the City of Everett. 17 D. FRONT YARD. "Front yard" shall mean that portion of property 18 between the street and a primary building. 19 E. LITTER. "Litter" includes but is not limited to rubbish, 20 debris, trash, and garbage. 21 F. MAINTAIN/MAINTENANCE. "Maintain" or "Maintenance" shall mean 22 condition on property that exists. 23 G. OWNER. "Owner" shall mean any person owning property, as 24 shown on the last assessment roll for taxes, or the lessee, tenant or other 25 person having control or possession of the property. 26 H. PERSON. "Person" shall mean any individual , partnership, 27 corporation, association or other organization, however formed. 28 I. PRIMARY BUILDING. "Primary building" shall mean a building which 29 is the primary use of the property upon which the building is located. 30 J. PROPERTY. "Property" shall mean all real property including any 31 buildings located thereon. 32
