w <br /> l ORDINANCE NO./6 6/-(? <br /> 2 <br /> AN ORDINANCE establishing minimum maintenance requirements for <br /> 3 property and repealing Ordinance No. ' s 1720 and 4058. <br /> 4 <br /> WHEREAS, the City Council finds that the City of Everett has statutory <br /> 5 <br /> authority to define and abate nuisances pursuant to RCW 35.22.280(30) ; and <br /> 6 <br /> WHEREAS, the City Council finds that the failure to provide minimum <br /> 7 <br /> maintenance of private property in the City of Everett constitutes a <br /> 8 <br /> nuisance; <br /> 9 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 <br /> Section 1 : DEFINITIONS. For the purpose of this ordinance, the <br /> 11 <br /> following definitions shall apply: <br /> 12 <br /> A. REAR YARD. "Rear yard" shall mean that portion of property <br /> 13 <br /> between the primary building and the rear property line. <br /> 14 <br /> B. BUILDING. "Building" shall mean any roofed and walled structure <br /> 15 <br /> for residential or non-residential use. <br /> 16 <br /> C. CITY. "City" shall mean the City of Everett. <br /> 17 <br /> D. FRONT YARD. "Front yard" shall mean that portion of property <br /> 18 <br /> between the street and a primary building. <br /> 19 <br /> E. LITTER. "Litter" includes but is not limited to rubbish, <br /> 20 <br /> debris, trash, and garbage. <br /> 21 <br /> F. MAINTAIN/MAINTENANCE. "Maintain" or "Maintenance" shall mean <br /> 22 <br /> condition on property that exists. <br /> 23 <br /> G. OWNER. "Owner" shall mean any person owning property, as <br /> 24 <br /> shown on the last assessment roll for taxes, or the lessee, tenant or other <br /> 25 <br /> person having control or possession of the property. <br /> 26 <br /> H. PERSON. "Person" shall mean any individual , partnership, <br /> 27 <br /> corporation, association or other organization, however formed. <br /> 28 <br /> I. PRIMARY BUILDING. "Primary building" shall mean a building which <br /> 29 <br /> is the primary use of the property upon which the building is located. <br /> 30 <br /> J. PROPERTY. "Property" shall mean all real property including any <br /> 31 <br /> buildings located thereon. <br /> 32 <br />
