• <br /> • <br /> 1 ORDINANCE NO. /0,? 2,:3-eke <br /> 2 <br /> AN ORDINANCE relating to the sale and distribution of malt liquor <br /> 3 in kegs or other containers, adding a chapter to the Everett <br /> Criminal Code (EMC Title 10). <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: There shall be added a new chapter to Title 10 (Everett Criminal <br /> 7 <br /> Code) of the Everett Municipal Code, to be entitled "Regulating the Sale and <br /> 8 <br /> Distribution of Malt Liquor," to be codified as Chapter 10.43, which shall read as <br /> 9 <br /> follows: <br /> 10 <br /> 11 10.43.010 Seller's Duties. <br /> 12 Any person who sells or offers for sale the contents of kegs or other <br /> containers containing six (6) gallons or more of malt liquor, or leases kegs <br /> 13 or other containers which will hold six (6) gallons of malt liquor, to <br /> consumers who are not licensed under Chapter 66.24 RCW shall do the <br /> 14 following for any transaction involving said container: <br /> 15 1. Require the purchaser of the malt liquor to sign a declaration and <br /> receipt for the keg or other container and/or beverage in substan- <br /> 16 tially the form provided herein. <br /> 17 2. Require the purchaser to provide two pieces of identification, one <br /> of which is a motor vehicle operator's license, Washington State <br /> 18 identification card, or military identification card. <br /> 19 3. Require the purchaser to sign a sworn statement, under penalty of <br /> perjury, that: <br /> 20 <br /> a. The purchaser is of legal age to purchase, possess or use <br /> 21 malt liquor; <br /> 22 b. That the purchaser will not allow any person under the age <br /> of twenty-one (21) to consume the beverage except as <br /> 23 provided by RCW 66.44.270; <br /> 24 c. That the purchaser will not remove, obliterate, or allow to <br /> be removed or obliterated, the identification number affixed <br /> 25 to the container. <br /> 26 4. Require the purchaser to state the particular address where the <br /> malt liquor will be consumed, or the particular address where the <br /> 27 keg or other container will be physically located. <br /> 28 5. Affix to each keg or container a numbered label, hereafter <br /> referred to as the identification number. <br /> 29 <br /> 6. Record the identification number, and any other number appearing <br /> 30 on the keg or container, on any declaration or receipt of purchase. <br /> 31 <br /> 32 <br />
