Ordinance No. 3009-07 7 y <br /> AN ORDINANCE providing for the adoption of the 2005 <br /> edition of the National Electrical Code, and repealing <br /> Ordinance No. 2364-99 (Chapter 16.05 EMC) . <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public <br /> health, safety and welfare; <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by <br /> this ordinance would create public harm and a public nuisance; <br /> WHEREAS, the City Council finds that the City is mandated by the State to <br /> implement and enforce the herein adopted code; <br /> WHEREAS, the City Council finds that it is appropriate for the Board of Review <br /> to have discretionary power to approve plans and a time frame for bringing existing <br /> buildings into compliance with the ordinance so long as the requirements are not waived <br /> and the time frame does not exceed one year; and <br /> WHEREAS, the City Council is aware that the 2005 National Electrical Code has <br /> been adopted by the State: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Short title. The ordinance codified in this chapter shall be known as the <br /> "Everett Electrical Code." <br /> Section 2: National Electrical Code adopted <br /> The 2005 National Electrical Code,published by the National Fire Protection <br /> Association, the Department of Labor and Industries Rules and Regulations for <br /> installing electrical wires and equipment and Administrative Rules (Chapter 19.28 <br /> RCW), and the Department of Labor and Industries Electrical Installation Law <br /> (Chapters-296-46B Washington Administrative Code), as adopted by the state of <br /> Washington, December 2006, are hereby adopted by reference except as such <br /> portions as are hereinafter deleted, amended or specified and incorporated herein <br /> as fully as if set out at length herein, collectively herein referred to as the "code" <br /> unless specifically provided otherwise. <br /> Section 3: National Electrical Code amended–Article 80 added <br /> A.
