eoe <br /> • <br /> 1 ORDINANCE NO. /'() ('O -S(e/ <br /> 2 AN ORDINANCE providing for the vacation of Pine Street between 12th <br /> 3 Street and 14th Street and a portion of 13th Street from Pine <br /> Street to the alley east of Pine Street. <br /> 4 <br /> 5 WHEREAS, the City Council of the City of Everett did, by resolution, duly adopt <br /> 6 and fix the 26th day of September, 1984, at 7:00 p.m., as the date for public hearing; <br /> 7 and <br /> 8 WHEREAS, due and legal notice of the time and place of said hearing and <br /> 9 determination of said resolution has been given by the City Clerk in the manner <br /> 10 prescribed by law; and <br /> 11 WHEREAS, at the time and place fixed for hearing, favorable statements and <br /> 12 objections to the vacating of the herein described street were heard and discussed; and <br /> 13 WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the <br /> 14 street which is vacated; and <br /> 15 WHEREAS, it now appears to the City Council of the City of Everett that the <br /> 16 said street resolved to be vacated should be vacated pursuant to the terms and <br /> 17 conditions of this ordinance; <br /> 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 19 Section 1: That the following described right-of-way: <br /> 20 <br /> Beginning at the Northwest corner of Block 231 of said Plat; thence West <br /> 21 on the North line of Block 231 projected to a point on the West line of <br /> said Plat for 80 feet; thence South on the West line of said Plat for 905 <br /> 22 feet to a point of intersection with the South line of Block 258 projected; <br /> thence East 80 feet to the Southwest corner of Block 258 of said Plat; <br /> 23 thence North along the West line of Block 258 of said Plat for 425 feet to <br /> the Northwest corner of said Block 258; thence East along the North line <br /> 24 of said Block 258 for 124 feet to the Northeast corner of Lot 1, Block 258 <br /> of said Plat; thence North 55 feet to the Southeast corner of Lot 17, <br /> 25 Block 231 of said Plat; thence West along the South line of said Block 231 <br /> for 124 feet to the Southwest corner of said Block 231, said point also <br /> 26 bears South from the point of beginning; thence North along the West line <br /> of said Block 231 for 425 feet to the point of beginning. <br /> 27 <br /> 28 be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. <br /> 29 Section 2: That the City of Everett shall not be responsible nor liable for <br /> 30 storm drainage runoff resulting from existing drainage patterns as established on City <br /> 31 rights-of-way that may currently, or in the future, go over, under, or across the <br /> 32 above-described street vacation. <br />
