• <br /> • <br /> • <br /> t • • <br /> • <br /> • <br /> 1 ORDINANCE NO. /0 5-6 t'/ <br /> 2 <br /> AN ORDINANCE relating to pawnbrokers and secondhand dealers and <br /> 3 repealing Chapter 8 of Ordinance No. 245-74 (EMC 5.32). jiA <br /> 4 <br /> WHEREAS, the Washington State Legislature in its 1984 regular session passed <br /> 5 <br /> SSB 4274 amending RCW 19.60 relating to the regulation of pawnbrokers and second- <br /> 6 <br /> hand dealers; and <br /> 7 <br /> WHEREAS, the City of Everett has authority to regulate pawnbrokers and <br /> 8 <br /> secondhand dealers pursuant to RCW 19.60; <br /> 9 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 <br /> Section 1: DEFINITIONS. Unless the context clearly requires otherwise, <br /> 11 <br /> the following definitions apply to this ordinance and other City of Everett ordinances <br /> 12 <br /> which now or hereinafter refer to the terms set forth below: <br /> 13 <br /> A. "Melted metals" means metals derived from metal junk or precious metals <br /> 14 <br /> that have been reduced to a melted state from other than ore or ingots which are <br /> 15 <br /> produced from ore that has not previously been processed. <br /> 16 <br /> B. "Metal junk" means any metal that has previously been milled, shaped, <br /> 17 <br /> stamped, or forged and that is no longer useful in its original form, except precious <br /> 18 <br /> metals. <br /> 19 <br /> C. "Nonmetal junk" means any nonmetal, commonly discarded item that is <br /> 20 <br /> worn out, or has outlasted its usefulness as intended in its original form except <br /> 21 <br /> nonmetal junk does not include an item made in a former period which has enhanced <br /> 22 <br /> 23 value because of its age. <br /> D. "Pawnbroker" means every person engaged, in whole or in part, in the <br /> 24 <br /> 25 business of loaning money on the security of pledges, deposits or conditional sales of <br /> 26 personal property. <br /> 27 E. "Precious metals" means gold, silver, and platinum. <br /> 28 F. "Secondhand dealer" means every person engaged in whole or in part in <br /> 29 the business of purchasing, selling, trading, consignment selling, or otherwise <br /> 30 transferring for value, secondhand property including metal junk, melted metals, <br /> precious metals, whether or not the person maintains a fixed place of business within <br /> 31 <br /> 32 the state. <br />
