• • 1 ORDINANCE NO. 9 J9 —14 2 AN ORDINANCE revising the procedures for damages, claims and 3 amending Sections 1, 4, 6 and 7 of Ordinance No. 288-74 (EMC 3.16.010, 3.16.040, 3.16.060 and 3.16.070). 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: Section 1 of Ordinance No. 288-74 (EMC 3.16.010) which reads as 7 follows: 8 9 All claims for damages or injuries against the City arising out of tortious conduct shall be presented in writing and filed with the Clerk of the City 10 of Everett within 120 days from the date that the damage occurred or the injury was sustained. 11 12 is hereby amended to read hereafter as follows: 13 All claims for damages or injuries against the City arising out of tortious 14 conduct shall be presented in writing and filed with the Clerk of the City of Everett. 15 16 Section 2: Section 4 of Ordinance No. 288-74 (EMC 3.16.040) which reads as 17 follows: 18 No action shall be maintained against the City for any claim for damage 19 or injuries until sixty (60) days have elapsed after presentation of such claim to the City Clerk of the City of Everett. 20 21 is hereby amended to read hereafter as follows: 22 No action shall be maintained against the City for any claim for damage 23 or injuries until presentation and filing of such claim with the City Clerk of the City of Everett. 24 25 Section 3: Section 6 of Ordinance No. 288-74 (EMC 3.16.060) which reads as 26 follows: 27 The City Attorney shall promptly examine all claims for damages or 28 injuries against the City submitted to him by the Clerk of the City of Everett. The City Attorney shall be and hereby is authorized to conduct 29 such investigation into the facts, circumstances and law relative to any claim for damages or injuries against the City as he, in the exercise of his 30 discretion, may deem necessary. Further, the City Attorney shall be authorized to negotiate the amount of any claim prior to payment. 31 32
