• <br /> • <br /> 1 ORDINANCE NO. 9 J9 —14 <br /> 2 <br /> AN ORDINANCE revising the procedures for damages, claims and <br /> 3 amending Sections 1, 4, 6 and 7 of Ordinance No. 288-74 (EMC <br /> 3.16.010, 3.16.040, 3.16.060 and 3.16.070). <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: Section 1 of Ordinance No. 288-74 (EMC 3.16.010) which reads as <br /> 7 <br /> follows: <br /> 8 <br /> 9 All claims for damages or injuries against the City arising out of tortious <br /> conduct shall be presented in writing and filed with the Clerk of the City <br /> 10 of Everett within 120 days from the date that the damage occurred or the <br /> injury was sustained. <br /> 11 <br /> 12 is hereby amended to read hereafter as follows: <br /> 13 <br /> All claims for damages or injuries against the City arising out of tortious <br /> 14 conduct shall be presented in writing and filed with the Clerk of the City <br /> of Everett. <br /> 15 <br /> 16 Section 2: Section 4 of Ordinance No. 288-74 (EMC 3.16.040) which reads as <br /> 17 follows: <br /> 18 <br /> No action shall be maintained against the City for any claim for damage <br /> 19 or injuries until sixty (60) days have elapsed after presentation of such <br /> claim to the City Clerk of the City of Everett. <br /> 20 <br /> 21 is hereby amended to read hereafter as follows: <br /> 22 <br /> No action shall be maintained against the City for any claim for damage <br /> 23 or injuries until presentation and filing of such claim with the City Clerk <br /> of the City of Everett. <br /> 24 <br /> 25 Section 3: Section 6 of Ordinance No. 288-74 (EMC 3.16.060) which reads as <br /> 26 follows: <br /> 27 <br /> The City Attorney shall promptly examine all claims for damages or <br /> 28 injuries against the City submitted to him by the Clerk of the City of <br /> Everett. The City Attorney shall be and hereby is authorized to conduct <br /> 29 such investigation into the facts, circumstances and law relative to any <br /> claim for damages or injuries against the City as he, in the exercise of his <br /> 30 discretion, may deem necessary. Further, the City Attorney shall be <br /> authorized to negotiate the amount of any claim prior to payment. <br /> 31 <br /> 32 <br />
