<br />   								AN ORDINANCE annexing certain property
<br />       								on Smith Island to the City of Everett
<br />   					WHEREAS, pursuant to R. C. W. 35.13.130, a petition was presented to the City
<br />  				Council of the City of Everett proposing the annexation of certain property; and
<br />   					WHEREAS,  the  petition  which  was  filed  pursuant to R.  C.  W.  35.13.130 was
<br />  				signed  by  owners  of  not  less  than  seventy-five  percent  in  value  according  to  the
<br />  				assessed valuation for general taxes of the property proposed to be annexed; and
<br />   					WHEREAS, the Council of the City of Everett, a municipal corporation did fix
<br />  				the September 29, 1982, for hearing upon said petition, and cause notice of hearing to
<br />  				be  published  in  one  issue  of  the  Everett  Daily  Herald,  a  newspaper  of  general
<br />  				circulation in the City, and caused said notice also to be posted in three places within
<br />  				the  territory  proposed  for  annexation,  which  notice  as  published  and  as  posted
<br />  				specified the time and place of hearing and invited interested persons to appear and
<br />  				voice approval of the annexation; and
<br />   					WHEREAS, following the hearing, the Council of the City of Everett, a municipal
<br />  				corporation, have determined to annex all of the property described in the petition as
<br />  				hereinafter set forth;
<br />   					WHEREAS, the Snohomish County Boundary Review Board invoked jurisdiction at
<br />  				their January 11, 1983, regular meeting, and set March 8, 1983, as the public hearing
<br />  				and continued the public hearing until March 21, 1983;
<br />   					WHEREAS, on March 21, 1983, following the hearing, the Boundary Review Board
<br />  				voted 4 - 0 to approve the annexation; and
<br />   					WHEREAS, the Snohomish County Boundary Review Board has issued its written
<br />  				findings on April 19, 1983, to this effect.
<br />   					NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br />   					Section  1:   That the property hereinafter described be, and the same is hereby
<br />  				annexed to the City of Everett:
<br />  				That portion of Sections 4,  5,  8, 9 and  16, Township 29 North, Range 5 East, W.M.,
<br />  				Snohomish County, Washington, more particularly described as follows:
<br />   				Beginning at the intersection of the MID-CHANNEL OF STEAMBOAT SLOUGH and
<br />  				the MID-CHANNEL of UNION SLOUGH; thence westerly along the MID-CHANNEL of
<br />   				STEAMBOAT SLOUGH a distance of 1,100 feet; thence due South to the centerline of
<br />  				a dike in that portion of Government Lot 4 in said Section 5; thence southwesterly
<br />  				along the centerline of said dike to the south line of said Government Lot 4, being the
<br />  				north line of the Northeast Quarter of the Southwest Quarter of said Section 5; thence
<br />  				continuing southwesterly along said center of said dike, 60 feet more or less to the
<br />  				MID-CHANNEL  of  an  existing  slough  in  the  South  Half  of  said  Section  5; thence
<br />  				continuing southeasterly on the MID-CHANNEL line of the slough to the west line of
<br />  				the East half of the Southeast Quarter of said Section 5; thence south on the west line
<br />  				of the East half of the Southeast Quarter of said Section 5 to the south line of said
<br />   				Section  5 and the northeast corner of Government Lot 2 in Section 8, Township 29
<br />  				North, Range 5 East, W.M.; thence south on the east line of said Government Lot 2 to
<br />  				intersect the Government Meander line; thence southeasterly along said Government
<br />  				Meander  Line  to  intersect  the  present  westerly  right-of-way  of  the  Burlington
<br />  				Northern R.R.; thence southerly on said right-of-way to intersect the MID-CHANNEL
<br />  				of  the  SNOHOMISH  RIVER;  thence  southeasterly  and  then  southerly on said MID-
<br />  				CHANNEL to a point of intersection with the South line of said Section  16; thence
<br />  				Northeasterly  to  a point of intersections  with  the  Easterly  right-of-way  margin of
<br />  				Interstate Road No. 5 (SR No. 1) and the North right-of-way margin of 4th Street N.E.;
<br />  				thence east on said northerly  right-of-way  line  to intersect the  MID-CHANNEL of
<br />  				UNION  SLOUGH;  thence  northerly  and  northeasterly  along  the  MID-CHANNEL  of
<br />  				UNION SLOUGH to intersect the east line of Section 16, Township 29 North, Range 5
<br />  				East, W.M.; thence northerly along the east line of said Section 16 to the northeast
<br />  				corner of said Section 16; thence northerly along the east line of Section 9, Township
<br />   				29 North, Range 5 East, W.M., to the extended present right-of-way line known as 12th
<br />  				Street N. E. extended easterly to intersect the east line of said Section 9;
