Chapter 18-44 and enacting an ordinance adopting new or revised regulations and procedures for the summary approval of short plats/subdivisions within the City of Everett. WHEREAS, the City Council of the City of Everett is required by State law to adopt regulations and procedures for the summary approval of short plats and short subdivisions or revisions thereto; and WHEREAS, the existing Chapter 18-44 of the E.M.C. does not adequately provide for the authorization of variations under special circumstances from the mandatory requirements of the ordinance controlling short subdivisions; and WHEREAS, representations have been made to the City Council by certain residents of the City of Everett for a number of minor revisions to the existing Chapter 18-44 of the E.M.C; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT DOES ORDAIN THAT: Section 1. Ordinance No. 369-75, more particularly described as Section 18.44.010 through 18.44.140 of the Everett Municipal Code and titled "Short Subdivisions" be repealed. Section 2. That the following be adopted and codified as the authorized regulations and procedures for summary approval of short plats/subdivisions: Sect. 010 Applicability Every division of land for the purpose of lease, sale or development into two (2) or more but less than five (5) lots within the City of Everett shall proceed in compliance with the provisions of the State laws and this title. Sect. 020 Exemptions The provisions of this resolution shall not apply to: (1) Cemeteries and other burial plots while used for that purpose. (2) Divisions made by testamentary provisions, the laws of descent, or upon court order, (3) Any division of land into five (5) or more lots, parcels, or tracts. (4) Boundary line adjustments of parcels not in a plat or short plat where access is not affected and where no new lot is created thereby or where no lot is reduced in size below the minimum square footage required by the applicable zoning controli (5) Divisions of land due to condemnation or sale under threat thereof, by an agency or division of government vested with the power of condemnation. (6) Divisions of land into lots or tracts each of which is one- one hundred twenty-eighth of a section of land or larger, or five acres or larger if the land is not capable of description as a fraction of a section of land. (7) Divisions not to be used for building purposes (road right-of- way, community open space, etc.)
