• 4 t �' <br /> • <br /> ORDINANCE NO,. 5l 1- 7 • <br /> AN ORDINANCE repealing Ordinance No. 369-75 more <br /> particularly described as E.M.C. Chapter 18-44 and <br /> enacting an ordinance adopting new or revised <br /> regulations and procedures for the summary approval <br /> of short plats/subdivisions within the City of Everett. <br /> WHEREAS, the City Council of the City of Everett is required by State <br /> law to adopt regulations and procedures for the summary approval of short <br /> plats and short subdivisions or revisions thereto; and <br /> WHEREAS, the existing Chapter 18-44 of the E.M.C. does not adequately <br /> provide for the authorization of variations under special circumstances from <br /> the mandatory requirements of the ordinance controlling short subdivisions; and <br /> WHEREAS, representations have been made to the City Council by certain <br /> residents of the City of Everett for a number of minor revisions to the <br /> existing Chapter 18-44 of the E.M.C; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT DOES ORDAIN THAT: <br /> Section 1. Ordinance No. 369-75, more particularly described as <br /> Section 18.44.010 through 18.44.140 of the Everett <br /> Municipal Code and titled "Short Subdivisions" be <br /> repealed. <br /> Section 2. That the following be adopted and codified as the <br /> authorized regulations and procedures for summary <br /> approval of short plats/subdivisions: <br /> Sect. 010 Applicability <br /> Every division of land for the purpose of lease, sale or <br /> development into two (2) or more but less than five (5) lots <br /> within the City of Everett shall proceed in compliance with <br /> the provisions of the State laws and this title. <br /> Sect. 020 Exemptions <br /> The provisions of this resolution shall not apply to: <br /> (1) Cemeteries and other burial plots while used for that purpose. <br /> (2) Divisions made by testamentary provisions, the laws of descent, <br /> or upon court order, <br /> (3) Any division of land into five (5) or more lots, parcels, or <br /> tracts. <br /> (4) Boundary line adjustments of parcels not in a plat or short <br /> plat where access is not affected and where no new lot is created <br /> thereby or where no lot is reduced in size below the minimum <br /> square footage required by the applicable zoning controli <br /> (5) Divisions of land due to condemnation or sale under threat <br /> thereof, by an agency or division of government vested with the <br /> power of condemnation. <br /> (6) Divisions of land into lots or tracts each of which is one- <br /> one hundred twenty-eighth of a section of land or larger, or five <br /> acres or larger if the land is not capable of description as a <br /> fraction of a section of land. <br /> (7) Divisions not to be used for building purposes (road right-of- <br /> way, community open space, etc.) <br />
