<br /> ORDINANCE NO. /-4. -9. -77
<br /> AN ORDINANCE adopting the Washington Model Traffic
<br /> Ordinance and other traffic statutes to regulate
<br /> traffic on the highways of the City of Everett and
<br /> repealing Ordinances and sections of Ordinances
<br /> in conflict therewith.
<br /> WHEREAS, a Model Traffic Ordinance (MTO) was developed by the
<br /> Association of Washington Cities in response to a pressing need for an
<br /> economical and effective method of keeping traffic ordinances up-to-date;
<br /> and
<br /> WHEREAS, Washington State Law provides that cities may adopt the
<br /> MTO or any section or sections thereof by reference or may at any time
<br /> exclude any section or sections from the MTO which it does not desire to
<br /> include in its local traffic ordinance adopting the MTO; and
<br /> WHEREAS, at any time the State Legislature amends or repeals any
<br /> section in the MTO, or adds a new section thereto, these changes will
<br /> automatically be reflected in the local traffic code unless the local
<br /> authority takes action to specifically exclude the changes;
<br /> WHEREAS, the Council of the City of Everett desires to implement
<br /> the MTO except as specifically excluded herein; and
<br /> WHEREAS, the Council of the City of Everett desires to repeal
<br /> existing Everett traffic ordinances except as specifically provided
<br /> therein;
<br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EVERETT:
<br /> Section 1. ADOPTION BY REFERENCE. The "Washington Model Traffic
<br /> Ordinance," Chapter 46.90 RCW, hereinafter referred to as the "MTO",
<br /> and RCW 46.52.088, 46.61.072, 46.61.202, 46.61.215, 46.61.261
<br /> 46.61.264, 46.61.266, 46.61.269, 46.61.520, 46.61.540, 46.61.606
<br /> 46.61.608, 46.61.614, 46.61.520, 46.61.510 and 46.64.017; together
<br /> with 46.52.020, 46.44.030, 46.16.380, 46.61.580, 46.64.015, 46.16.135,
<br /> 46.16.137, 46.16.145, 46.44.020, 46.44.036, 46.44.037, 46.44.042,
<br /> 46.44.047, 46.44.050, 46.44.090, 46.44.091, 46.44.092, 46.44.095,
<br /> 46.44.096, and 46.44.130 as amended by 1975-1976 2nd Extraordinary
<br /> Session of the Washington Legislature are hereby adopted by reference
<br /> as and for the traffic ordinance of this city as if set forth in
<br /> full herein except as provided in Section 2;
<br /> And except 46.44.040, 46.44.044, 46.44.045, 46.44.046, and 46.44.097
<br /> as repealed by 1975-1976 2nd Extraordinary Session of the Washington
<br /> Legislature.
