00.7.444. �L � . - 7 z- <br /> . <br /> ORDINANCE NO. u 7 I-- <br /> AN <br /> AN ORDINANCE providing for claims for damages, or <br /> injuries against the City arising out of tortious <br /> conduct and providing for the presentation, examination, <br /> 1 allowance or disallowance, and payment of such claims. <br /> 2 Section 1: <br /> 3 All claims for damages or injuries against the City arising out of <br /> 4 tortious conduct shall be presented in writing and filed with the Clerk of <br /> 5 the City of Everett within 120 days from the date that the damage occurred <br /> 6 or the injury was sustained. <br /> 7 Section 2: <br /> 8 All claims for damages or injuries against the City, provided for in <br /> 9 Section 1 hereinabove, shall accurately state the time, place, source, <br /> 10 nature and extent of the alleged damage or injuries, and give the actual <br /> 11 residence of the claimant by street and number at the date of presenting <br /> 12 such claim and for six months immediately prior to the time such claims <br /> 13 for damages accrued and shall be verified by affidavit of the claimant, or <br /> 14 such other person, as may be authorized by law to verify such claims to the <br /> 15 effect that the same is true. <br /> 16 Section 3: <br /> 17 The omission to present any claim for damages or injuries against the <br /> 18 City in the manner or within the time this ordinance provides shall be a bar <br /> 19 to any action against the City therefor. <br /> 20 Section 4: <br /> 21 No action shall be maintained against the City for any claim for damage- <br /> 22 or injuries until sixty (60) days have elapsed after presentation of such claim <br /> 23 to the City Clerk of the City of Everett. <br /> 24 Section 5: <br /> 25 Upon presentation of any claim for damages or injuries against the City, <br /> 26 the Clerk of the City of Everett shall indelibly mark on such claim the date <br /> 27 of receipt and shall forthwith deliver a true and complete copy of said <br /> 28 claim to the City Attorney. <br /> 29 Section 6: <br /> 30 The City Attorney shall promptly examine all claims for damages or <br /> 31 injuries against the City submitted to him by the Clerk of the City of Everett. <br /> 32 <br />
