1 <br /> 4 <br /> ,IP(O%v/=1 <br /> RESOLUTION NO. 5382 <br /> A Resolution Approving the Rezone of a <br /> Portion of the Port of Everett Property, Located <br /> North of the North Marina Boat Channel, South of the <br /> 10th Street Boat Launch, west of West Maine View Drive and <br /> east of the Everett Harbor Line, from Maritime Services (MS) <br /> to North Marina Planned Development Overlay Waterfront <br /> Commercial (W-C) and Authorizing the Mayor to <br /> Execute the Development Agreement. <br /> WHEREAS, the City of Everett and the Port of Everett have worked together cooperatively on <br /> the Port's proposed land use change in the 120 acre North Marina area; and <br /> WHEREAS,The Port has worked with Maritime Trust to create a master plan concept which <br /> will provide improved public access, retail, office, special events, housing and expanded marina <br /> support capabilities; and <br /> WHEREAS, the resulting project, if carried out according to agreements and conditions set <br /> forth in this Resolution, will complement the City's downtown services and uses in a way that <br /> will increase Everett's attraction as a regional center; and <br /> WHEREAS, the Everett City Council held a public hearing on September 17, 2003, to hear from <br /> the Port and take public testimony on the North Marina Planned Development Overlay Zone <br /> (PDO-WC) for the Port's North Marina Redevelopment Project; and <br /> WHEREAS, the Everett City Council finds: <br /> 1. A Revised Mitigated Determination of Non Significance (SEPA#02-058) for the Port's <br /> proposal was issued on July 10, 2003; and <br /> 2. The Everett Planning Commission was introduced to the proposal on December 17, 2002, <br /> held a workshop on April 20, 2003, then opened the public hearing on June 17, continued it to <br /> July 1, 2003, and held the decision public hearing regarding the proposal on July 15, 2003; and <br /> 3. The Everett Planning Commission on July 15, 2003, after closing its public hearing, voted <br /> unanimously to recommend that the North Marina PDO-WC Zone, and the Development <br /> Agreement with Design Standards &Guidelines developed for this project be approved; <br />
