• <br /> • <br /> '41 off <br /> ...IP <br /> RESOLUTION NO. 4753. <br /> A RESOLUTION approving an amendment to a Planned Residential <br /> Development (Schnitzer Merrill Creek Apartments West on Merrill Creek <br /> Parkway) allowing the construction of two additional apartment units and <br /> amending Resolution No. 4644. <br /> WHEREAS, Schnitzer Northwest LLC filed an application for an amendment to the Resolution <br /> of Intent to Rezone property located on the north side of Merrill Creek Parkway between <br /> Narbeck Creek and Merrill Creek, Resolution No 4644, for property which is legally described in <br /> Exhibit A which is attached hereto and incorporated by reference. The amendment would allow <br /> construction of two additional apartment units within Buildings W and Y. The revised proposal <br /> includes a total of 220 apartment units and 422 parking stalls; and <br /> WHEREAS, the Hearing Examiner, after holding a public hearing, did make certain findings, <br /> conclusions, and recommendations, and did recommend to the Everett City Council that the <br /> application be approved pursuant to the provisions of Chapters 19.32.130 and 19.41.160.D.7 of <br /> the Everett Municipal Code, and shall be subject to the specific conditions set forth in said <br /> Recommendation; and <br /> WHEREAS, on August 12, 1998 the Everett City Council did pass and approve Resolution No. <br /> 4644, with conditions, authorizing preliminary approval of a 218-unit multiple family <br /> development; and <br /> WHEREAS, the City of Everett, hereinafter referred to as "City," finds that in approving the <br /> requested amendment that the proposal would be consistent with the PRD standards contained in <br /> EMC Chapter 19.32 and would not have an significant adverse impact on the environment under <br /> SEPA. <br /> NOW,THEREFORE, BE IT RESOLVED that the Everett City Council hereby amends <br /> Resolution No. 4644, with the following conditions: <br /> 1. Two additional apartment units can be developed as part of the project over and above the <br /> number authorized in Resolution No. 4644 bringing the total number of units of the <br /> proposed project to 220 units. These units are located in Buildings W and Y of the <br /> proposed development. <br /> 2. Traffic impact mitigation fees must be paid prior to the issuance of building permits, per <br /> the Interim Traffic Mitigation Ordinance for a maximum of 220 units. <br />
