RESOLUTION NO. 4753.
A RESOLUTION approving an amendment to a Planned Residential
Development (Schnitzer Merrill Creek Apartments West on Merrill Creek
Parkway) allowing the construction of two additional apartment units and
amending Resolution No. 4644.
WHEREAS, Schnitzer Northwest LLC filed an application for an amendment to the Resolution
of Intent to Rezone property located on the north side of Merrill Creek Parkway between
Narbeck Creek and Merrill Creek, Resolution No 4644, for property which is legally described in
Exhibit A which is attached hereto and incorporated by reference. The amendment would allow
construction of two additional apartment units within Buildings W and Y. The revised proposal
includes a total of 220 apartment units and 422 parking stalls; and
WHEREAS, the Hearing Examiner, after holding a public hearing, did make certain findings,
conclusions, and recommendations, and did recommend to the Everett City Council that the
application be approved pursuant to the provisions of Chapters 19.32.130 and 19.41.160.D.7 of
the Everett Municipal Code, and shall be subject to the specific conditions set forth in said
Recommendation; and
WHEREAS, on August 12, 1998 the Everett City Council did pass and approve Resolution No.
4644, with conditions, authorizing preliminary approval of a 218-unit multiple family
development; and
WHEREAS, the City of Everett, hereinafter referred to as "City," finds that in approving the
requested amendment that the proposal would be consistent with the PRD standards contained in
EMC Chapter 19.32 and would not have an significant adverse impact on the environment under
SEPA.
NOW,THEREFORE, BE IT RESOLVED that the Everett City Council hereby amends
Resolution No. 4644, with the following conditions:
1. Two additional apartment units can be developed as part of the project over and above the
number authorized in Resolution No. 4644 bringing the total number of units of the
proposed project to 220 units. These units are located in Buildings W and Y of the
proposed development.
2. Traffic impact mitigation fees must be paid prior to the issuance of building permits, per
the Interim Traffic Mitigation Ordinance for a maximum of 220 units.
3. For the two additional units, special charges for connection to the sewer and water
systems in accordance with Ordinance 1998-94 and subsequent revisions are applicable.
The actual charges shall be computed by the Public Works Department per the ordinance
in effect at the time of building permit issuance.
4. Additional school mitigation fees must be paid to the Mukilteo School District for the
two additional units. A receipt of such payment must be provided to the Planning
Department prior to issuance of a building permit.
5. For the total of 220 units, a minimum of 422 parking stalls is required.
6. The proposal must comply with all other City Code and Ordinance requirements
including those not specifically set forth herein.
7. The two additional units, including their design and location, must be consistent with the
submittals with the instant application as reviewed by the City of Everett Planning
Department.
FINAL ACTION - For purposes of the Land Use Petition Act,the passage of this Resolution is a
land use decis't 'tuting the final determination by the City.

City of Everett by deed recorded under Snohomish County
Recording Numbers 8902060299 and 8903310596 and Westerly of
the following described line:
BEGINNING at the Northeast corner of said West half; thence
North 88°09'31' West, along the North line of said West half, for
400.00 feet to the true point of beginning of the line to be
described:
