Application dated 5/23/90 <br />After due consideration of the testimony and evidence presented by the <br />Applicant; testimony and evidence elicited during the public hearing; and as <br />the result of the personal inspection of the subject property and surrounding <br />areas by the Everett Nearing Examiner, the following findings of fact and <br />conclusions constitute the basis of the decision of the Everett Nearing <br />Examiner. <br />FINDINGS OF FACTS <br />1. The application is a request for approval of a Special Property Use <br />Permit for property located at 4201 Rucker Avenue, Everett, Washington. <br />The specific request is to allow the lease of 10,000 square feet of an <br />existing 24,000 square foot building on the subject property for the use <br />of the Washington State Department of Revenue. <br />2. The subject property is zoned B-2, R-4, and C-0. Pursuant to the <br />provisions of the Everett Zoning Code (EZC), 41.150.D, a Special <br />Property Use Permit is required if a government administrative office, <br />such a proposed by the Applicant, is located out of the B-3, Central <br />Business District Zone in the area south of Everett Avenue and north of <br />Pacific Avenue in the City of Everett. <br />3. The subject property is a 39,600 square foot parcel of land on which <br />there is a 24,000 square foot, three-story office building that is used <br />as a bank and other offices. It is the intent of the Applicant to <br />relocate the administrative offices of the Washington State Department <br />of Revenue at the subject property. <br />4. The properties to the north and south of the subject property are <br />developed with commercial use and are zoned B-2. There is also some <br />R-4, Co®ercial Office zoning, south of the property. The properties to <br />the east and west of the subject property are developed with commercial <br />and Single-family development. The property east of the subject <br />property is zoned R-4 and C-0, while the property west of the subject <br />property is Toned B-2. <br />
