Morse Construction Group <br />Site Plan Modification <br />Page -2- <br />After due consideration of the testimony and evidence presented by the <br />Applicant; testimony and evidence elicited during the public hearing; and as <br />the result of the personal inspection of the subject property and surrounding <br />areas by the Everett Hearing Examiner, the following findings of fact and <br />conclusions constitute the basis of the decision of the Everett Hearing <br />Examiner. <br />FINDINGS OF FACTS <br />1. On July 11, 1984, the City of Everett and the predecessor in interest to <br />the Applicant entered into a Concomitant Agreement to rezone property <br />north of Lenora Street and west of South First Avenue, Everett, <br />Washington. As part of the Concomitant Agreement, the Applicant was <br />permitted to develop the site with a commercial structure, the offices <br />of the Maltby Tank and Barge Company. <br />2. According to the site plan that was approved, parking on -site was <br />required under the structure. Such parking was constructed. <br />3. The Applicant's bubiness needs have increased, and as a result, more <br />office space is necessary. Rather than expand the area of the building, <br />the Applicant requested modification of the site plan in order to allow <br />conversion of the understructure parking to office space and to place <br />the parking above ground on the western and eastern portions of the site. <br />4. Access to the on -site parking will be via a new 16 foot drive off South <br />First Avenue. <br />5. Surface parking on -site originally placed the parking on Lenora Street. <br />However, it was determined by the Applicant and the City that the street <br />was too steep and would create safety hazards. Further, it would remove <br />significant landscaping on -site. As a result, the parking as proposed <br />on the western and eastern portions of the site was designed. <br />6. The total parking spaces available in the existing building are <br />eighteen, the same as the existing parking requirements for the site. <br />The proposed parking spaces on the western and eastern sides of the <br />structure will provide eighteen parking spaces. In addition, <br />landscaping and other design features will be preserved oa-site. <br />7. The Applicant submitted that there is no history of parking problems in <br />the area and that all of the existing parking spaces are seldom filled. <br />8. A Witness (Gail Chism) submitted a concern about the existing parking <br />and views. Her main concern was the preservation of a visually pleasing <br />site and the preservation of safety in the area. She also voiced <br />concern about where overflow parking is to be located. She contended <br />that because some of the parking in the rear of the site is not used, <br />overflow parking occurs on Lenora Street. Because of the steepness of <br />Lenora Street, traffic hazards exist. <br />
