I <br /> I1 In doing the Work, the Contractor shall: <br /> 2 <br /> I 3 1. Not degrade water in a way that would harm fish, wildlife, or their habitat. <br /> 4 <br /> 5 2. Not place materials below or remove them from the ordinary high water line <br /> I 6 except as may be specified in the Contract. <br /> 7 <br /> 8 3. Not allow equipment to enter waters of the State except as specified in the <br /> 9 Contract. <br /> 10 <br /> 11 4. Revegetate in accordance with the Plans, unless the Special Provisions permit <br /> 12 otherwise. <br /> I 13 <br /> 14 5. Prevent any fish-threatening silt buildup on the bed or bottom of any body of <br /> 15 water. <br /> I 16 <br /> 17 6. Ensure continuous stream flow downstream of the Work area. <br /> 18 <br /> I 19 <br /> 20 7. Dispose of any project debris by removal, burning, or placement above high-water <br /> flows. <br /> 21 <br /> 22 8. Immediately notify the Engineer and stop all work causing impacts, if at any time, <br /> I 23 as a result of project activities, fish are observed in distress or a fish kill occurs. <br /> 24 <br /> 25 If the Work in (1) through (3) above differs little from what the Contract requires, the <br /> 26 Contracting Agency will measure and pay for it at unit Contract prices. But if Contract items <br /> 27 do not cover those areas, the Contracting Agency will pay pursuant to Section 1-09.4. Work <br /> 28 in (4) through (8) above shall be incidental to Contract pay items. <br /> I 29 <br /> 30 1-07.5(3) State Department of Ecology <br /> 31 This section is revised to read: <br /> 32 <br /> 1 33 In doing the Work, the Contractor shall: <br /> 34 <br /> 35 1. Comply with Washington State Water Quality Standards. <br /> I 36 <br /> 37 2. Perform Work in such a manner that all materials and substances not specifically <br /> 38 identified in the Contract documents to be placed in the water do not enter waters <br /> I 39 of the State, including wetlands. These include, but are not limited to, petroleum <br /> 40 products, hydraulic fluid, fresh concrete, concrete wastewater, process <br /> 41 wastewater, slurry materials and waste from shaft drilling, sediments, sediment- <br /> 42 laden water, chemicals, paint, solvents, or other toxic or deleterious materials. <br /> I 43 <br /> 44 3. Use equipment that is free of external petroleum-based products. <br /> 45 <br /> 46 4.
