I <br /> I1 ten business days before the scheduled date of commencement of excavation. <br /> 2 The Contractor shall make its own investigations, including exploratory <br /> I 3 excavations, to determine the locations and type of existing utilities, including <br /> 4 service connections, prior to commencing Work that could result in damage to <br /> 5 such utilities. The Contractor shall immediately notify the Owner's Representative <br /> I 6 as to any utility discovered by him in a different position than shown on the <br /> 7 Drawings or which is not shown on the Drawings. No excavation shall begin until <br /> 8 all known facilities in the excavation areas have been marked. The Contractor <br /> 9 shall coordinate its activities with the utility provider. The Contractor shall bear the <br /> I 10 cost of maintaining utility service. <br /> 11 <br /> 12 The Contractor should be aware of, and comply with, RCW Chapter 19.122, a law <br /> I 13 relating to underground utilities. The Owner shall not pay Contractor any of <br /> 14 Contractor's cost of complying with this law, and repairing or indemnifying any <br /> 15 damage or injury arising out of Contractor's failure to comply with this law. <br /> I 16 <br /> 17 The Owner does not represent or warrant who may be obligated to pay for the <br /> 18 cost of relocation or temporary maintenance of the utility. The Contractor shall <br /> 19 investigate whether such cost must be borne by the owner of the utility. <br /> I 20 <br /> 21 Governmental agencies and owners of utilities reserve the right to enter upon <br /> 22 streets, alleys, Rights-of-Way, or easements for the purpose of making changes in <br /> I 23 their property made necessary by the Work and for the purpose of maintaining <br /> 24 and making repairs to their property. <br /> 25 <br /> I <br /> 26 <br /> 27 1-04.2(3)(C)(2) Known Utilities <br /> The Contractor shall provide at its sole expense all labor, Equipment, materials <br /> 28 and services necessary to remove, relocate, or maintain utilities specified on the <br /> 29 Drawings. The Work on each utility shall be performed in a manner satisfactory to <br /> I <br /> 30 the utility owner. The utility owner has the option of doing such Work with its own <br /> 31 forces at the Contractor's expense, or permitting the Work to be performed by the <br /> 32 Contractor. <br /> I 33 <br /> 34 1-04.2(3)(C)(3) Service Connections <br /> 35 Locations of service connections are not identified on the Drawings. The <br /> I 36 Contractor shall provide at its sole expense all labor, Equipment and material to <br /> 37 remove, relocate or maintain service connections. Work on service connections <br /> 38 shall be performed in a manner satisfactory to the service connection owner. The <br /> 39 service connection owner has the option of doing such work with its own force at <br /> II 40 the Contractor's expense, or permitting the work to be performed by the <br /> 41 Contractor. <br /> 42 <br /> I 43 1-04.2(3)(C)(4) Unknown Utilities <br /> 44 When a utility interferes with the Work and is either (1) not identified on the <br /> 45 Drawings or (2) located in a position significantly different from that specified on <br /> I <br /> 46 <br /> 47 the Drawings, the Contractor shall follow the procedures of Section 1-04.7 <br /> Differing Site Conditions (Changed Conditions). Interference with the Work is <br /> 48 defined as a utility that crosses or projects into the plane of the Work at an <br /> 49 elevation between the top and bottom of the Work. If it is necessary to remove, <br /> 50 relocate, or temporarily maintain the utility, that Work shall be included in a <br /> 51 Change Order.
