I <br /> 1 Specifications, any related Work performed prior to completion of the Engineer's review of I <br /> 2 the pertinent submission will be the sole expense and responsibility of the Contractor. <br /> 3 <br /> I <br /> 4 Supplement Section 1-05.3 by adding the following: <br /> 5 <br /> 6 1-05.3(1) Submittals <br /> I <br /> 7 Where required by the Contract Documents, the Contractor shall submit information which <br /> 8 will enable the City's Representative to advise the City whether the Contractor's proposed <br /> 9 materials, Equipment or methods of Work are in general conformance to the design <br /> 10 concept and in compliance with the Drawings and Specifications, such as catalog cuts and <br /> I <br /> 11 Shop, Working or detail Drawings. Approval or acceptance of a submittal does not relieve <br /> 12 the Contractor from complying with Contract requirements. The City's approval of a <br /> 13 submittal does not constitute a waiver of the Contract requirements. The City will not be t <br /> 14 obligated to accept or pay for Work performed by the Contractor which may be affected by <br /> 15 materials, Equipment, or methods of Work not submitted in a timely manner so that final <br /> 16 review can be accomplished before the affected Work is complete. The City shall not be <br /> I <br /> 17 responsible for delays, inefficiencies, or any additional costs or expenses caused in whole <br /> 18 or in party by the Contractor's failure to submit required information in sufficient time for <br /> 19 review, comment, and correction. The Contractor's failure to submit required information in <br /> 20 sufficient time for review, comment and correction shall be deemed a waiver of any and all <br /> I <br /> 21 Contract Claims for adjustment of Contract Sum or Contract Time arising out of, or related <br /> 22 to, such a Submittal. The Contractor acknowledges and agrees that it may not rely upon <br /> 23 receiving the City's response to a Submittal in less than ten (10) working days, unless the <br /> I <br /> 24 City explicitly changes this Section by a signed Change Order. <br /> 25 <br /> 26 1-05.3(2) Requests for Information <br /> I <br /> 27 Requests for information or clarification from the Contractor to the City shall be treated as a <br /> 28 Submittal pursuant to Section 1-05.3(1) Submittals. <br /> 29 ,30 1-05.4 Conformity With and Deviations From Plans and Stakes <br /> 31 Delete all of Section 1-05.4 and substitute the following: <br /> 32 <br /> 33 The Contractor shall be responsible for setting and maintaining all alignment stakes, slope 1 <br /> 34 stakes, and grades necessary for the construction of the Roadbed, surfacing, paving, <br /> 35 channelization, illumination, signing, bridges, and retaining walls, if such construction is <br /> 36 included in this Project. Except for the survey control data to be furnished by the City, <br /> I <br /> 37 calculations, surveying, and measuring required for setting and maintaining the necessary <br /> 38 lines and grades shall be the Contractor's responsibility. The Contractor shall provide the <br /> 39 City with copies of such calculations and staking data when requested by the Engineer. <br /> I <br /> 40 Copies of the City-provided survey control data are available for the Bidder's inspection at <br /> 41 the office of the Project Engineer. <br /> 42 <br /> 43 Any staking requirements for the Project that do not fit field conditions will be reviewed and <br /> I <br /> 44 if necessary adjusted by the Engineer. Any necessary revision to the staking information <br /> 45 will be provided to the Contractor for use in completing the Work. <br /> 46 <br /> 47 Stakes, marks, and other reference points, including existing monumentation, set by the <br /> 48 City shall be carefully preserved by the Contractor.
