I <br /> 1 1-05.18(3)(B) Contractor's Employees I <br /> 2 The Contractor shall be responsible for the adequacy, efficiency and sufficiency of its <br /> 3 employees. Workers shall have sufficient knowledge, skill and experience to perform I 4 properly the Work assigned to them. <br /> 5 <br /> 6 1-05.18(3)(C) Payment for Labor and Materials I 7 The Contractor shall pay and require its Subcontractors to pay any and all accounts for <br /> 8 labor including Worker's Compensation premiums, State Unemployment and Federal <br /> 9 Social Security payments and other wage and salary deductions required by law. The <br /> 10 Contractor also shall pay and cause its Subcontractors to pay any and all accounts for <br /> I <br /> 11 services, Equipment, and materials used by the Contractor and its Subcontractors <br /> 12 during the performance of Work under this Contract. The Contractor shall pay such <br /> 13 accounts as they become due and payable. If requested by the City, the Contractor I 14 shall promptly furnish proof of payment of such accounts to the City. <br /> 15 <br /> 16 1-05.18(3)(D) Attention to Work <br /> 17 The Contractor, acting through its representative, shall give personal attention to and <br /> 18 shall manage the Work so that it shall be prosecuted faithfully and completed under <br /> 19 the Project schedule. When its representative is not personally present at the Project <br /> 20 site, its designated alternate shall be available and shall have the authority to act in <br /> I <br /> 21 matters relating to this Contract. <br /> 22 <br /> 23 1-05.18(3)(E) Safety <br /> I <br /> 24 The Contractor alone shall be responsible for safety on the job site, including, but not <br /> 25 limited to, the safety of its and its Subcontractor's employees. The Contractor shall <br /> 26 maintain the Project site and perform the Work in a manner which meets the City's I 27 responsibility under statutory and common law for the provision of a safe place to <br /> 28 Work. <br /> 29 <br /> 30 1-05.18(3)(F) Threats, Intimidation and Harassment Forbidden <br /> 31 The Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> 32 employees, or any other agents to threaten bodily injury or property damage, to <br /> 33 intimidate or attempt to intimidate any person, or to assault or physically harass any I 34 person. Forbidden conduct includes, but is not limited to, threatening, appearing, or <br /> 35 actually doing any of the following: pushing, shoving, striking, physically blocking a <br /> 36 person or a person's vehicle, vandalism, malicious mischief, or any other act that a I 37 reasonable person would understand be intended to intimidate, cause personal injury, <br /> 38 or cause property damage. The Contractor shall remove from the job site any person <br /> 39 reasonably under its control or direction who the Contractor or City reasonably <br /> 40 believes violated this section. The lack of a request from the City or City's <br /> I <br /> 41 Representative to the Contractor to remove someone from the job site does not relieve <br /> 42 the Contractor from its obligation to remove someone. <br /> 43 <br /> I <br /> 44 1-05.18(3)(G) Weapons Forbidden <br /> 45 The Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> 46 employees, or any other agents or representatives to carry or possess, openly or I 47 concealed, explosives or weapons on the job site, except: (a) such explosives are as <br /> 48 reasonably required for performance of the Work, such as those necessary for blasting <br /> 49 or demolition Work called for by the Contract Documents or (b) commissioned law <br /> 50 enforcement officers or security personnel under authority of their commission.
