I 1 1-05.18(3)(B) Contractor's Employees I 2 The Contractor shall be responsible for the adequacy, efficiency and sufficiency of its 3 employees. Workers shall have sufficient knowledge, skill and experience to perform I 4 properly the Work assigned to them. 5 6 1-05.18(3)(C) Payment for Labor and Materials I 7 The Contractor shall pay and require its Subcontractors to pay any and all accounts for 8 labor including Worker's Compensation premiums, State Unemployment and Federal 9 Social Security payments and other wage and salary deductions required by law. The 10 Contractor also shall pay and cause its Subcontractors to pay any and all accounts for I 11 services, Equipment, and materials used by the Contractor and its Subcontractors 12 during the performance of Work under this Contract. The Contractor shall pay such 13 accounts as they become due and payable. If requested by the City, the Contractor I 14 shall promptly furnish proof of payment of such accounts to the City. 15 16 1-05.18(3)(D) Attention to Work 17 The Contractor, acting through its representative, shall give personal attention to and 18 shall manage the Work so that it shall be prosecuted faithfully and completed under 19 the Project schedule. When its representative is not personally present at the Project 20 site, its designated alternate shall be available and shall have the authority to act in I 21 matters relating to this Contract. 22 23 1-05.18(3)(E) Safety I 24 The Contractor alone shall be responsible for safety on the job site, including, but not 25 limited to, the safety of its and its Subcontractor's employees. The Contractor shall 26 maintain the Project site and perform the Work in a manner which meets the City's I 27 responsibility under statutory and common law for the provision of a safe place to 28 Work. 29 30 1-05.18(3)(F) Threats, Intimidation and Harassment Forbidden 31 The Contractor shall not allow its employees, its Subcontractors, its Subcontractors' 32 employees, or any other agents to threaten bodily injury or property damage, to 33 intimidate or attempt to intimidate any person, or to assault or physically harass any I 34 person. Forbidden conduct includes, but is not limited to, threatening, appearing, or 35 actually doing any of the following: pushing, shoving, striking, physically blocking a 36 person or a person's vehicle, vandalism, malicious mischief, or any other act that a I 37 reasonable person would understand be intended to intimidate, cause personal injury, 38 or cause property damage. The Contractor shall remove from the job site any person 39 reasonably under its control or direction who the Contractor or City reasonably 40 believes violated this section. The lack of a request from the City or City's I 41 Representative to the Contractor to remove someone from the job site does not relieve 42 the Contractor from its obligation to remove someone. 43 I 44 1-05.18(3)(G) Weapons Forbidden 45 The Contractor shall not allow its employees, its Subcontractors, its Subcontractors' 46 employees, or any other agents or representatives to carry or possess, openly or I 47 concealed, explosives or weapons on the job site, except: (a) such explosives are as 48 reasonably required for performance of the Work, such as those necessary for blasting 49 or demolition Work called for by the Contract Documents or (b) commissioned law 50 enforcement officers or security personnel under authority of their commission.
