I <br /> I1 to inflict harm or injury to another person; or (2) any item used in a manner threatening <br /> 2 harm or injury to another person. Weapons include, but are not limited to, firearms, <br /> I <br /> 3 dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or <br /> 4 other weapons. Further, weapons should include those described EMC Chapter 10.78. <br /> 5 Possession of mace, pepper spray or the like for defensive purposes is not a violation <br /> I <br /> 6 <br /> 7 of this policy. The Contractor shall remove from the job site any person reasonably <br /> under its control or direction who the Contractor or City reasonably believes violated <br /> 8 this section. The lack of a request from the City or City's Representative to the <br /> 9 Contractor to remove someone from the job site does not relieve the Contractor from <br /> I 10 <br /> 11 its obligation to remove someone. <br /> 12 1-05.18(3)(H) Safety Standards <br /> 13 The Contractor shall comply with Section 107 of the Contract Work Hours and Safety <br /> 14 Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor <br /> 15 Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not require any <br /> 16 laborer or mechanic to Work in surroundings or under working conditions that are <br /> I17 unsanitary, hazardous, or dangerous to its health and safety as determined under <br /> 18 construction, safety, and health standards promulgated by the Secretary of Labor. <br /> 19 These requirements do not apply to the purchase of supplies or materials or articles <br /> I <br /> 20 <br /> 21 ordinarily available on the open market, or contracts for transportation or transmission <br /> of intelligence. <br /> 22 <br /> I 23 1-05.18(3)(1) Public Safety and Convenience <br /> 24 The Contractor shall conduct its Work so as to ensure the least possible obstruction to <br /> 25 traffic and inconvenience to the general public, business, organizations and residents <br /> I26 in the vicinity of the Work and to reasonably protect persons and property. No roads or <br /> 27 street shall be closed to the public except with the permission of the City's <br /> 28 Representative and the proper governmental authority. Fire hydrants on or adjacent to <br /> 29 the Work shall be accessible to fire-fighting Equipment. Temporary provisions shall be <br /> I 30 made by the Contractor for the use of sidewalks, private and public driveways and <br /> 31 proper functioning of gutters, sewer inlets, drainage ditches and culverts, irrigation <br /> 32 ditches and natural water courses. <br /> I <br /> 33 <br /> 34 1-05.19 City-Contractor Coordination <br /> 35 The following New subsection is added to Section 1-05 as follows: <br /> I 36 <br /> 37 1-05.19(1) Suggestions to Contractor <br /> 38 Nothing in these Contract Documents requires the City's Representative to provide the <br /> 39 Contractor with direction or advice on how to do the Work, construction practices, or means <br /> I40 and methods. If the City's Representative approves, suggests or recommends any <br /> 41 construction practice, means, method or manner for doing the Work or producing materials, <br /> 42 the approval or recommendation shall not: (A) guarantee that following the method or <br /> I <br /> 43 <br /> 44 manner will result in compliance with the Contract Documents; (B) relieve the Contractor of <br /> any risks or obligations under the Contract Documents; or (C) create any liability by the City <br /> 45 to the Contractor. <br /> I 46 <br /> 47 Suggestions as to the plans or methods of accomplishing the Work or Contract <br /> 48 requirements by the City or the City's Representative to the Contractor but not specified or <br /> I49 required, if adopted or followed by the Contractor in whole or in part, shall be used at the <br /> 50 risk and responsibility of the Contractor.
