I <br /> 1 provided at the time the referenced material or Equipment is delivered to the job site. <br /> 2 Provide data as specified and include, unless otherwise specified, but not be limited to <br /> I 3 Shop Drawings, erection drawings, reinforcing steel schedules, testing and adjusting <br /> 4 instructions, operations manuals, maintenance procedures, parts lists, and Record <br /> 5 Drawings. Provide data as part of the Work under this Contract and its acceptability will be <br /> I <br /> 6 determined by the City in its sole discretion. <br /> 7 <br /> 8 Further supplement 1-06.1 by adding the following: <br /> 9 <br /> I10 1-06.1(5) Requests for Substitution <br /> 11 The City will not usually consider a substitution for material or Equipment specified by <br /> 12 brand name or manufacturer or sole-sourced. <br /> I 13 <br /> 14 Only the Contractor may offer materials or Equipment of equal or better quality and <br /> 15 performance as a substitution for those specified. The Contractor shall make substitution <br /> I 16 offers in writing to the City's Representative in accordance with Section 1-05.3(1) <br /> 17 Submittals of these Special Provisions. The substitution offer must include sufficient data <br /> 18 to enable the City's Representative to assess the acceptability of the material or Equipment <br /> 19 for the particular application and requirements. The City and City's Representative are not <br /> I20 required or obligated to consider or review a request for substitution and may, in their sole <br /> 21 discretion and option, consider or review such requests. <br /> 22 <br /> I 23 If the offered substitution requires changes to or coordination with other portions of the <br /> 24 Work, include, if any, drawings and details showing such changes. The Contractor agrees <br /> 25 to perform these changes as part of the substitution of material or Equipment at no <br /> I <br /> 26 additional cost to the City. Approval of a substitution request will not relieve the Contractor <br /> 27 from responsibility for the efficiency, quality, and performance of the substitute material or <br /> 28 Equipment, in the same manner and degree as the material and Equipment originally <br /> 29 specified. Reflect cost differential associated with a substitution in the offer. If the City <br /> I30 approves the substitution, the Contract Documents will be modified by a Change Order <br /> 31 modifying the Contract Sum in the amount of the cost differential. <br /> 32 <br /> I 33 1-06.2 Acceptance of Materials <br /> 34 Delete Section 1-06.2(2)B Financial Incentive <br /> 35 Delete Section 1-06.2(2)D Quality Level Analysis <br /> I 36 <br /> 37 1-06.3 Manufacturer's Certificate of Compliance <br /> 38 Supplement 1-06.3 by adding the following: <br /> 1 39 <br /> 40 When authorized by the Standard Specifications or these Special Provisions and prior to <br /> 41 use, the Engineer may accept certain Equipment on the basis of a Manufacturer's <br /> 42 Certificate of Compliance as an alternate to Equipment inspection and testing. <br /> I 43 <br /> 44 A Manufacturer's Certificate of Compliance shall be reserved for cases where compliance <br /> 45 to Contract requirements is not readily determinable through inspection and testing of <br /> I 46 materials or Equipment.
