An 1,.T.:'. for the North -South Right: -of -Way acquisition and development shall be formed <br />in the event the P.U.D. exerciues i.ts termination rights on vehicular access use of <br />• the existing P.U.D. ROW or in the event that the City Engineer determines such public <br />improvements be made. <br />b. The applicant shall convey powers of attorney for the creation of Local Improvement <br />Districts (L.I.D.) for purpo:;es of construction public improvements to 100th Street, <br />7th Avenue S.E., South Broadway and acquiring ROW and constructing public improvements <br />to the North -South street to be constructed between 100th Stre^t and South Broadway. <br />Such power of attorney form shall be -approved by the City Attorney and executed and <br />delivered within 30 days of the issuance of any initial building permit-. <br />c. The applicant shall improve the existing PUD Right -of -Way to City standards prior <br />to the issuance of occupancy permits for the new buildings. This Right -of -flay <br />shall be maintained according to City standards as long as it is utilized as a primary <br />access to the Mall area. <br />d. The applicant shall be responsible for design, acquisition and i-nstallation of a <br />traffic control signal at its own expense at the existing PUD ROW. The cost of this <br />signal shall be credited to the applicants share of LID improvements for South <br />Broadway when such LID is carried out according to -a formula calculated on benefit to <br />the general traveling public. <br />The Public Works Director shall. approve the type and design of the signal device <br />to be installed. This condition shall be complied with or a written agreement <br />providing for compliance with this condition shall be executed within 30 days of <br />the issuance of any initial building permit. <br />The traffic signal at this location shall be installed prior to the issuance of <br />occupancy permits for the new buildings. <br />e. The applicant shall contribute to the extent of its level of benefit in relation <br />to other developing properties for the cost of installation of a traffic signal <br />at the Mall's existing center driveway on South Broadway. The Public Forks <br />Director shall approve the type and design of the signal device to be installed. <br />This driveway shall also be marked with four traffic lanes according to standards <br />established by the City Traffic Engineer. it written agreement providing for <br />compliance with this condition shall be executed within 30:days of the issuance <br />of any initial building permit. The applicant will receive a credit on an L.I.D. <br />assessment for South Broadway L.I.D. if the center driveway. traffic signal has <br />been installed prior to the L.I.D. <br />f. The applicant shall cooperate with the City and the County in the development of a <br />carpool match program by agreeing to distribute questionnaires to employees who <br />would choose to voluntarily participate in a computer matching program. <br />g. Also with regard to carpooling. The applicant shall agree to: <br />(1) Establish a central "board" and regional map with two types of cards - <br />ride wanted or rider wanted type for empolyees to seek out their own <br />match if the computer matching program fails to materialize by <br />December, 1981, <br />(2) Provide preferential up front parking priviledges for carpool <br />employees. <br />h. The applicant shall agree to provide bus schedule/route information racks or <br />displays at a central location within the Mall. <br />i. The applicant shall agree to provide bicycle racks at the main entrance off <br />Broadway and between Payless and Frederick and Nelson in a safe and convenient <br />manner for the use of both customers and employees. <br />J. Conditions f) through i) above shall be complied with or a written agreement <br />providing for compliance with this condition shall be executed prior to issuance <br />of an occupancy permit. <br />0 <br />
