The Contractor shall replace all plants and associated 2 materials rejected or missing and correct unsatisfactory conditions. 3 4 Completion of the initial planting within a designated area includes the following I 5 6 conditions: 7 1. 100 percent of each of the plant material categories are installed as shown I 8 in the Plans. 9 10 2. Planting Area is cleaned up. I 11 12 3. Repairs are completed, including but not limited to, full operation of the 13 irrigation system. 14 I 15 4. Mulch coverage is complete. 16 17 5. All weeds are controlled. I 18 19 8-02.3(13) Plant Establishment 20 Plant establishment consists of caring for all plants and planting areas within the I 21 project limits. The provisions of Sections 1-07.13(2) and 1-07.13(3) do not apply to 22 this Section. 23 24 When the Proposal includes the bid item PSIPE (Plant Selection Including Plant I 25 Establishment), that bid item includes one year of plant establishment Work. The first 26 year of plant establishment shall begin immediately upon written notification from the 27 Engineer of the completion of initial planting for the project. The first-year plant I 28 establishment period shall be a minimum of one calendar year. The one calendar 29 year shall be extended an amount equal to any periods where the Contractor does 30 not comply with the plant establishment requirements and plan. I 31 32 During the first-year plant establishment period, the Contractor shall perform all Work 33 necessary to ensure the resumption and continued growth of the transplanted 34 material. This Work shall include, but is not limited to, applying water, removing I 35 foreign, dead, or rejected plant material, maintaining all planting areas in a weed-free 36 condition, and replacing all unsatisfactory plant material planted under the Contract. 37 If plants are stolen or damaged by the acts of others, the Contracting Agency will pay I 38 invoice cost only for the replacement plants with no mark-up and the Contractor will 39 be responsible for the labor to install the replacement plants. Other weed control 40 within the project limits but outside of planting, lawn, or seeding areas shall be as I 41 specified in Section 8-02.3(3)C. 42 43 During the first year of plant establishment, the Contractor shall meet monthly or at 44 an agreed upon schedule with the Engineer for the purpose of joint inspection of the I 45 planting material. The Contractor shall correct all unsatisfactory conditions identified 46 by the Engineer within a 10-day period immediately following the inspection. If plant 47 replacement is required, the Contractor shall, within the 10-day period, submit a plan I 48 and schedule for the plant procurement and replacement to occur during the planting 49 period as designated in Section 8-02.3(8). At the end of the plant establishment 50 period, plants that do not show normal growth shall be replaced and all staking and I 51 52 guying that remain on the project shall be removed unless otherwise allowed by the Engineer.
