3 <br /> Pipeline License from BNSF.This work will include the following subtasks to be performed by the <br /> Consultant: <br /> 5.1 Prepare a SEPA checklist for submittal to the City of Everett with 30%design drawings. <br /> 5.2 Prepare a Biological Assessment for the project. <br /> 5.3 Complete an ordinary high water mark delineation approximately 50 feet on either side of the <br /> existing culvert. The line will be marked where feasible with flagging,but may need to be <br /> marked with paint because of the substrate. <br /> 5.4 Prepare a Joint Aquatic Resource Permit Application(JARPA)for the project. <br /> 5.5 Prepare a restoration plan for the project. <br /> 5.6 Prepare and submit permit submittal packages to City of Everett for SEPA and Shoreline <br /> Substantial Development Permits,Washington Depat talent of Fish and Wildlife(WDFW)for <br /> Hydraulic Project Approval,Washington State Department of Ecology(Ecology)for Section <br /> 401 Water Quality Certification,and the Corps of Engineers(Corps)for a Section 404 <br /> permit. <br /> 5.7 Prepare a site restoration plan. This plan will include recommendations for surface <br /> stabilization for areas disturbed during construction.This will likely include hydroseeding <br /> and some recommendations for shrubs and small trees where appropriate. Based on our <br /> current understanding of the project,we do not anticipate needing a plan to mitigate for <br /> impacts to sensitive areas. <br /> 5.8 Prepare application and supporting documents for a new or amended BNSF Pipeline License. <br /> Task 5 Assumptions <br /> • The Consultant will submit and track permit applications with WDFW,Corps, and Ecology. <br /> • The City will coordinate application submittal to the City of Everett for the SEPA, and <br /> Shoreline permit and coordinate any other construction related permits. The consultant will <br /> be available for responding to comments from the City reviewers,related to SEPA or <br /> Shoreline issues. <br /> • The project will not result in any permanent impacts to the beach or other critical area. <br /> • No forage fish surveys will be needed and no habitat mitigation for impacts will be required. <br /> • The City will coordinate application submittal and negotiations related to the BNSF Pipeline <br /> License.The Consultant will be available for responding to comments from BNSF. <br /> Task 5 Deliverables <br /> • SEPA Checklist <br /> • Biological Assessment <br /> • SEPA application <br /> • Shoreline substantial development application <br /> • JARPA application <br /> • BNSF Pipeline License application <br /> City of Everett-Shore Avenue Storm water Outfall Improvements KPG,Inc. <br /> Exhibit A—Scope of Work Page 4 of 7 4 April 2013 <br /> 17 <br />
