* A GC/CM Contract <br /> General Contractor/Construction Manager Services for <br /> ��T Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> This GC/CM Contract is entered into pursuant to the provisions of Chapter 39.10 RCW. <br /> As set forth in RCW 39.10.350, if the cost to construct the Work exceeds the MACC <br /> such extra costs shall be the responsibility of the GC/CM unless the MACC is adjusted <br /> by Change Order pursuant to the terms of the Contract Documents. The GC/CM <br /> agrees that the Project is adequately defined, that the Drawings and Specifications are <br /> at least 90% complete, and has determined that the Project is sufficiently clear and <br /> understandable for the GC/CM to agree to the TCC in this Contract. <br /> Phased MACC: Phase C of the WPCF has been divided into Phase Cl and Phase C2. <br /> The first phase, Phase Cl, consists of work related to the Liquid Stream improvements, <br /> and is the subject of this Contract as defined in the Contract Documents. <br /> Owner intends to attempt to negotiate a MACC with the GC/CM for a new contract <br /> covering Phase C2, Solids Handling improvements, at the appropriate time. If Owner is <br /> unable to negotiate a satisfactory MACC with GC/CM for Phase C2, GC/CM agrees to <br /> cooperate with Owner to effectuate a smooth and orderly transition between itself and <br /> the contractor selected by the Owner to construct Phase C2. <br /> This GC/CM Contract is not based on any promise or commitment by the Owner that it <br /> will in fact enter into a contract with the GC/CM for Phase C2. <br /> ARTICLE 1 - DEFINITIONS <br /> In addition to the definitions set forth in the General Conditions, the following definitions <br /> shall apply to this Contract. <br /> 1.1. Contract Documents: The "Contract Docurtients" consist of the following: <br /> 1.1.1. This General Contractor/Construction Manager Contract including, but <br /> not limited to, Attachment 1 through Attachment 9 <br /> 1.1.2. General Conditions of the GC/CM Contract, included in this Contract <br /> as Attachment 6, dated November 25, 2013 <br /> 1.1.3.
