9 <br /> GC/CM Contract �' <br /> General Contractor/Construction Manager Services for <br /> :sa./IENT„ ;�;T Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> 3.6. Certificate of Occupancy: The GC/CM shall obtain any necessary <br /> governmental approvals necessary for the Owner to take beneficial use of the <br /> Project or any partially completed portion of the Project when notified in <br /> writing by the Owner. The Owner shall provide a commissioning authority. <br /> The coordination for obtaining such approvals is a Specified General <br /> Condition Cost. <br /> ARTICLE 4.- RELATIONSHIP OF THE PARTIES <br /> 4.1. General: <br /> 4.1.1. The GC/CM accepts the relationship of trust and confidence <br /> established by this Contract and covenants with the Owner to <br /> cooperate with the Owner and Engineer through every Phase of the <br /> Work and utilize the GC/CM's best skill, efforts and judgment in <br /> furthering the interests of the Owner; to furnish efficient business <br /> administration and supervision; to make best efforts to furnish at all <br /> times an adequate supply of workers and materials; and to perform the <br /> Work in the best way and most expeditious and economical manner <br /> consistent with the interestsofthe Owner. The GC/CM recognizes that <br /> the Owner has a separate agreement with the Engineer to design the <br /> Project and to provide certain construction administration services <br /> necessary to ensure that the construction is in accordance with the <br /> Contract Documents. The GC/CM shall closely cooperate on a regular <br /> basis to revise materials, methods, estimates and schedules as <br /> necessary to perform and complete the Work within the Total Contract <br /> Cost and consistent with the Contract Time unless adjusted by Change <br /> Order. <br /> 4.2. Partnering: <br /> 4.2.1. The Owner and GC/CM agree to utilize the "partnering" concept for <br /> this Project. Partnering emphasizes a cooperative" approach to <br /> problem solving involving all key parties to the Project: Owner, <br /> Engineer, GC/CM and principal Subcontractors. <br /> 4.2.2. One workshop to define partnering relationships will be scheduled not <br /> to exceed one day or as mutually agreed.
