7 <br /> GC/CM Contract <br /> General Contractor/Construction Manager Services for <br /> Eucf.Frr Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> 7.2. Competitive Bidding Required: Other than the Specified General Conditions <br /> and Negotiated Support Services work, all Work, including procurement of <br /> equipment and materials, on the Project shall be competitively bid with public <br /> bid openings. Subcontract work shall not be issued for bid until the GC/CM <br /> has completed the requirements of Section 7.4.2 herein. <br /> 7.2.1. The GC/CM shall make every effort possible to secure at least three <br /> subcontract bids for each package. If the GC/CM receives less than <br /> three bids, the Owner, at its discretion, may require that the GC/CM re- <br /> bid the package at no additional cost to the Owner or impact to the <br /> schedule. This applies to all subcontract bid packages including the <br /> packages whereby the GC/CM decides to submit a bid. <br /> 7.3. Self-Performance by GC/CM: The GC/CM or its subsidiaries may bid on <br /> subcontract work and/or supply of equipment and materials for which the <br /> GC/CM customarily performs or supplies. GC/CM's interest in the Work shall <br /> not diminish its duty to aggressively seek competition for bid packages. In the <br /> event the GC/CM or its subsidiaries will be bidding on subcontract work, any <br /> subcontractor eligibility or bidder responsibility criteria will be reviewed by and <br /> must be approved by the Owner, the bid receipt and opening will be managed <br /> by the Owner, and notice of the GC/CM's intention to bid shall be included in <br /> the public solicitation for bids for that bid package. In no event may the value <br /> of the subcontract work performed by or materials and equipment supplied by <br /> the GC/CM exceed thirty percent (30%) percent of the MACC. Negotiated <br /> Support Services performed by the GC/CM shall not be considered <br /> subcontract work for the purposes of calculating the 30% threshold. In no <br /> event may the GC/CM or its subsidiaries purchase equipment or materials <br /> and assign ownership and warranty of such equipment or materials to <br /> Subcontractors, but may assign the equipment or materials to Subcontractors <br /> for installation as part of a subcontract bid package. <br /> 7.3.1. The GC/CM must provide staff to superintend and manage subcontract <br /> packages it undertakes as self-performed. work that is .separate and <br /> distinct from the staff involved in the management of this Contract. <br /> 7.4. Subcontract Buyout Procedure: <br /> 7.4.1. Award to Low Bidder: When subcontract bid packages are awarded, <br /> they shall be awarded by the GC/CM to the responsible bidder <br /> submitting the low responsive bid.
